Gender must be based on the presence of two "X" chromosomes or the presence of an "X-Y" pair. Those with combinations such as "X-Y-Y" should be a new gender call "psycho."

Marriage is a fundamental right of all persons.

Gender provides no compelling excuse for denial of this fundamental right.

Denial of this right based on gender, is clearly discrimination.

Fundamental rights should not depend on your understanding of what those rights mean to others. You need to demonstrate a compelling government interest if you seek to impose your restrictions and deny to others the rights you expect for yourself.

Your argumnet is premised on a faulty assumption. Where in the U. S. Constitution does it explicitly say that "marriage is a fundamental right of all persons?"

I did not ask what the courts said - I asked if in the constitution itself, there was explicit mention of marriage as a right. Appellate decisions can be overturned - such as Roe v. Wade (hopefully soon).

The 9th amendment explains that the listing of rights does not mean those not listed are not rights. It explains all rights not previously listed remain the rights of the people, not the government.

The Supreme Court on 14 occasions has declared and affirmed marriage is one of those fundamental right not listed, but included and protected under the equal protections clauses of the 5th and 14th amendments.

Zablocki v. Redhail, 434 U.S. 374, 384 (1978):“The right to marry is of fundamental importance for all individuals.”

Turner v. Safley, 482 U.S. 78, 95 (1987):“The decision to marry is a fundamental right”

You call me stupid, yet accuse me of not being humble. hmmmm.

Deny the law if you must, but marriage has firmly been established as a fundamental right of all persons on 14 occasions by the Supreme Court. That means restrictions can only be made if they provide a compelling and legitimate government interest. Restrictions on gender provide no such interest. The only compelling interests involve protecting children and others, with restrictions on age, informed consent, incest and number.

If you want to deny to others the rights you expect for yourself, you need to demonstrate a compelling interest for doing so, and gender fails that test.
