Considering the way the Oklahoma Castle law is worded, why was this man even charged?

Because he went beyond the wording of that law and committed murder.

Pretty straightforward, really...

Because the DA has about as much integrity as Allred.

How do you "murder" a DEAD person?? That POS was 99.9%
DEAD before the 2nd shot ever hit him!! YOU know that too,
you bleeding heart LIBERAL! You don't know what YOU would do
until YOUR life is threatened. Oh ya, you'd quickly reach out your
hand say say, "Can't we just get along and sing "Kum by Ya" together
Mr. Robber/ Murderer???" Good luck with that!!

So, you're actually trying to suggest that it wasn't murder because he was already dead. But that would mean he emptied five rounds into a corpse.

So your "defense" is that Ersland isn't a murderer because he's a psychopath.

Yeah, that's not mental at all...

Forty years ago, John F. Kennedy was assassinated by the same ultra right wing elements in the United States who rule today. When these extremists assassinated Kennedy they seized a moment in history and radically transformed America into a wasteland of lost opportunities, forever killing the hopes that this country once had to be a decent nation. And America has never been able to recover from those stolen opportunities by the extremist right wing. America is now spiraling deeper and deeper into the abyss of fascism.

Complicit in this plot to rob America of it's rightful future was the CIA under Allen Dulles and the FBI under J. Edger Hoover.

Today the conspiracy to coverup the true facts surrounding the right wing's assassination of Kennedy continues with a massive coordinated effort by the CIA controlled major media to obliterate the facts surrounding the conspiracy to kill Kennedy and reinforce the widely dismissed and disbelieved lie that Oswald acted alone.

The 40th anniversary of Kennedy's assassination has become once again a field day for the right wing extremists who control the media to churn out lie after lie about how Oswald acted alone. With bogus 3D reenactments designed to fool the eye and boggle the mind.

It is a chilling reality today that there is such divide between what is really real and what the official media backed presentation of that reality is. Nearly the entire major media is nothing more than a huge brainwashing machine churning out disinformation carefully scripted by the puppet-masters of the New World Order. CNN, ABC, CBS, NBC, FOX are all under the complete control of the New World Order industrialists. Nearly all "news" on these channels are lies.

NOW THE ONLY RELIABLE SOURCE OF INFORMATION LEFT IS THE INTERNET.

All other forms of information can and are compromised.

Soon America will descend into a military dictatorship and any resemblance to great nation it once was will be lost forever.

A BBC Radio 4 investigation sheds new light on a major subject that has received little historical attention, the conspiracy on behalf of a group of influential powerbrokers, led by Prescott Bush, to overthrow FDR and implement a fascist dictatorship in the U.S. based around the ideology of Mussolini and Hitler.

Ersland should be given a medal. I would have done the same thing and I am a liberal! Anyone that comes on my property with the intention of hurting me or my family will suffer the same fate as the sub human savage that Ersland shot while defending himself and his fellow employees!

Yes, because we should be rewarding homicide instead of prosecuting it. I'm certain that criminals around the world agree with you.

They call that "abuse of a corpse", that's the maximum he could have been charged with.....In my opinion...

No, but being pro-murder does.

The great thing about analyzing this case is that it is exceptionally straightforward.

Ersland committed murder. Period. If you are okay with that then you are in favor of murder. Period.

Show where it says in the castle doctrine law that murder is sanctioned. It isn't. I've talked to a lot of people who have this inate ability to imagine verbiage in these laws where none exists and now we the direct results of such a belief in Ersland's conviction.

"HB 2615 simply states that if a criminal breaks into your home, your occupied vehicle or your place of business, you may presume he is there to do bodily harm and you may use any force necessary against him. It also removes the "duty to retreat" if you are attacked in any place you have a legal right to be.

Further, HB 2615 provides protection from criminal prosecution and civil litigation for those who defend themselves from criminal attack. The "Castle Doctrine" bill met with overwhelming, bipartisan support, passing 96-2 in the state House and 83-4 in the Senate."

The 'you may use any force' part is what suggested it. That and the 'protection from criminal prosecution.'

And not one letter of that states that it is legal for you, once the attacker is incapacitated, to execute that attacker.

But feel free to find that wording. We'll be waiting...

Bama let me see if I can explain this better because all Michael is doing is being rude. Here is where the problem comes in: If Ersland had only shot Parker the first time around and he died no charges would have been filed. However Ersland went back behind the counter got a second gun and came back and unloaded 5 more rounds into Parker when he was clearly not a threat anymore. What he should have done is when he went behind the counter the second time to get the 2nd gun he should have also called the police and then he could have stood there over Parker to make sure he didn't move until the police got there. However he passed the phone twice and didn't think about calling the police until after he unloaded the 2nd gun and was sure that Parker was dead. That is the legal description as to why he was charged with murder.

If people want to really complain about a miscarriage of justice they should do so about the Stephen Wolf case. He killed an unarmed 10 year old child who posed no threat and he was just aquitted.
