Of course Capital Punishment was NOT created to be a general deterrent .... it was created to PUNISH (perish the thought) a killer. And, just coincidentally, it became a complete deterrent to the person so punished.
While Mr. Liberal Cohen is wallowing in his own preconceived notion of self-brillance, his somewhat muted analysis of Sonia Sotomayor is spot on., except that on numerous occasions during her testimony she uttered the incorrect word; such as her use of 'emminently' when she clearly meant 'imminently'...a Judge needs to be aware that words have meaning.
The best description of Sotomayor is her own .... she is a poster child for affirmative action!
Reminds one of the greatness of Martin Luther King's concept of Content of character over color of skin! Surely It's time the Liberals acknowledged the truth of this!

Mr. Cohen fails to recognize that the bright ideas, the new thinking, the fresh look, is supposed to come from the Congress, not from the courts, who are charged to judge cases based on current law as enacted by Congress based in the Constitution, not to change the law themselves into what they individually wish it to become. As far as Judge Sotomayor herself is concerned, she is quite obviously putting forth the face to the Senate which is felt will get her confirmed. At the same time, it is quite obvious that her statements and writings over many years put the lie to what she is currently saying in the Senate. As Mr. Cohen says, we will see, but I find it hard to believe that her beliefs of many years standing suddenly changed on the day she was nominated by the President.

The NRA is taking aim at Sotomayor! Senators who support her will have bullseyes on their person! Ammo for the ballot box is going to be very plentyiful!
