All we have to do is tie up the petitions in court until after the Nov election, then drop all legal challenges, then gays can start marrying in Jan 2013.

I say do it openly, plainly and blatantly.

Do it *in front of their faces*-- as they have ADMITTED OPENLY and publicly that they are doing this in the California gay marriage case.

I will never, never stop advocating this no matter what *any* living person thinks of it: These people are monstrosities and rapists. The pro-gay would do best to become *as they are*-- behaving that way SOLELY when dealing with the antigay, but doing it in spades and doing it with a ferocity that makes them feel hopeless as shit.

They need so much more of their own medicine than they are getting.

Maryland was one of the first states to ban SSM. For years at nearly every election the anti gays have tried every trick in the book to get the question on the ballot and failed.

If the succeed this year there is a very good chance they will be on the losing side Nov. 3 2012.

Maryland was the First State to ban religious discrimination. I hope they will follow that this year as well. Opposing SSM IS religious discrimination.

I'm not sure if people are actually thinking that far ahead.

If the referendum doesn't make it onto the 2012 ballot, the soonest it can be voted on would be Nov 2014- the next regular US congressional election. So that would be almost 2 years- Jan 2013 to Nov 2014- of same-sex couples getting married before it goes to the ballot.

I see nothing in law or Maryland constitution which would prevent that strategy.

In which case we'd have the same situation that happened in CA. I can forsee a point in time where SCOTUS will have to rule on this issue: Can a right, once granted and labeled a fundamental right by SCOTUS be repealed by popular vote?

You are correct. That's precisely why they amended the bill so it wouldn't take effect until Jan 2013. Normally bills take effect in October of the year they are passed, but they moved the effective date to give voters a chance to have their veto referendum. They obviously didn't realize they could just delay past the Nov election.

It will be interesting to see how SCOTUS words such a ruling. I assume that WHEN SCOTUS rules in our favor, it would also rule that all those States with Constitutional amendments banning SSM are unconstitutional. But could they somehow rule SSM is a fundamental right and still leave those State Constitutional Amendments intact by claiming States Rights?

It would be nearly impossible to rule same-sex couples have a fundamental constitutional right to marry while still allowing states to abridge that same right.

That said, the court COULD rule that the federal govt has to recognize all marriages, but allow the states to decide on their own.

Brad Pitt will wield a gavel in the gay-marriage battle, playing a federal judge in the play "8," which will have its L.A. premiere in a one-night reading Saturday at the Wilshire Ebell Theatre. Pitt joins his pal George Clooney and several other celebrities for the benefit event that also will be streamed live on YouTube.

The play "8," by Oscar-winning screenwriter Dustin Lance Black, is based on the court case Perry vs. Schwarzenegger, which sought to overturn Prop. 8, the ballot initiative banning same-sex marriage in California.(The case is now known as Perry vs. Brown.)

Pitt is set to play U.S. District Chief Judge Vaughn R. Walker, who presided over the 12-day case in 2010. Clooney will play David Boies, an attorney representing the plaintiffs in the case.
