Liaquat and Liphe Ali have been tormented since the civil action was started by their neighbour Iqban Suleman in July last year An Edgware couple went through "a year of hell" when a neighbourly dispute over the placement of a wheelie bin ended up in court with a A 21,000 legal bill.

Yeah right... court is the only route!

Sh*t lawyers like this clogging up the Courts with trials over wheelie bins... pull the other one! So the courts and legal system are then clogged up and the real murderers, rapists, crooks get off scott free. The guy is a computer analyst with a family and two kids! I think this law firm (Googled it) and it looks like Lyons Davidson, should be the one going to Court and giving a good bollocking by the judge for letting this charade go on!

I used to know a geezer called Suleman, who was and probably still is a bus driver at Cricklewood bus garage. He was a bit of a trouble-maker too, union type shop steward, accused of falsifying signatures and so in in a racial discrimination case a few years back. He even went on a march a few years earlier around October 2003 in Downing street and he used a megaphone to try and heckle the Prime Minister, Tony Blair at the time! I wonder if this guy, causing all the problem over a wheelie bin, is the same person. If so, his contact details are:-

I'm gonna wade into the chat... I'm a bus driver working for TFL but I've been keeping quiet too long! If this is the same Suleman which my uncle, also a bus driver in Cricklewood garage knows, then read on... my uncle told me this trouble-maker always rants on in the canteen, bragging off to his pals about how he fixed it for an old neighbour in a flat in Edgware using his insurance to sue over a wheelie bin that the neighbour left in his own parking bay because Suleman kept taking up that parking bay when Suleman accused him of his car being damaged by that bin! He also said he's gonna "stitch up" his new neighbours in Edgware using his insurance and he's gonna get his accountant to write some dodgy letters about business loss because his car is being trapped by the neighbours bin in the alleyway. I think this would be one for the police and the insurance company to get to grips with. Can't remember who the neighbour was in Edgware but if you are reading these postings, I wouldn't be surprised if Suleman is STITCHING YOU UP with a bent insurance claim, bent accountant and bent lawyer! He's using his Unite the Union insurance to do it too! Get a Private Eye or write to the Union rep and make a complaint. He got away with it once, so hope he doesn't get away with it again. BTW my uncle doesn't drink tea with him anymore and wouldn't touch him with a barge pole!

Report the "gentleman" and bent "law firm" to the Socialist Worker. In hard times with money tight, families starving, jobs on the line, lack of housing, NHS cuts and so on, the last thing we want is pond life who infiltrate unions to siphon off union funds through insurance claims on figments of their imagination (I.E. THERE'S A WHEELIE BIN, HELP!). Name a shame this shyster and fraud.

Hello Mr Ali, it is "money isn't a problem"....

With regards this Suleman -v- Ali £36,370 wheelie bin trial, I hear from my neighbour that you are going to a costs assessment and possible hearing.... mate listen carefully, no one would get a CCFA agreement over a wheelie bin!!!!!

I phoned Lyons Davidson just two days ago and they told me a wheelie bin dispute in a shared driveway is one for the Citizens Advice Bureau.(Date and time of call logged).

What's happened is your lovely neighbour does NOT have a CCFA agreement in place OR if he does, he must have faked or exaggerated his claim using terms like you are trespassing over HIS driveway and so on because he is running a car fleet business or something like that.

CONCLUSION: GET THE COSTS JUDGE TO EXAMINE THE CCFA AGREEMENT IN COURT!

ONCE THE GUY IS FOUND OUT, ITS THE SLAMMER FOR HIM AND HIS WOMAN AND POSSIBLE CRIMINAL CHARGES FOR HIS SOLICITOR TOO.

I read from another website the £622 claim for "damages" was "abandoned" by Suleman. I wonder if he or his legal representative told his CCFA funder about that! he, he, he.... If there are no "damages" or "losses", what is the claim for? Suleman may be paying back all the money to his insurers and the defendants once this gets out! Definitely some sort of insurance scam!

Mr Ali, I heard from my neighbour you are asking for the no win, no fee documents to be disclosed... the whole street is chatting.

If they refuse, read this story BUT you might have it covered by your barrister anyway:-

Marion Henry v British Broadcasting Corporation [2005] EWHC 2503 (QB) 11.11.05

The Judge said there were no grounds for claiming that the ATE policy is privileged and hoped that in future ATE policies in CFA cases will be disclosed as a matter of course to the opposite party. It turned out that the level of cover under Ms Henry's policy was only £100,000.

The Judge drew attention to the problems that may arise in terms of the validity of the ATE policy. Ms Henry's policy contained significant exclusion causes which provided that the insurer should not be liable for the opponent's costs if the legal action was lost, discontinued or abandoned "as a result of the dishonesty of the insured", or if the insured or his appointed legal adviser had given "any fraudulent, false or misleading information in connection with the legal action" or had "failed to provide any material information in connection with the legal action". The BBC's defence of justification involved allegations of deception and cover up on the part of the Claimant. If the BBC's defence succeeded the Judge noted that "it is, to put it no higher, very likely that the insurer would be able to disclaim liability for the costs incurred by the 'opponent' ie the BBC."

We Barnet residents think they better have their CCFA funding (Mr Ali mentioned there were two) or it may be a custodial sentence and as stated in that report "Straight to jail" for trying to steal money over a wheelie bin dispute.

We're following your case Mr Ali. Has the case gone to the Costs Hearing yet?

Here are some useful tips so don't make the same mistakes as me:
1. Get the name of the insurance funder,
2. Tell the insurance company about this 30th June 2011 "incident date" when on that day these shysters are accusing you and the Council bin men of blocking the alleyway, that would be a hard act to follow!
3. Show the insurance company all the photos of the shysters bins in the alleyway too AFTER 30th June 2011... saw those photos on the SFH website, nice one! Question then is how would any insurance companny believe a lying shyster!

Anyway here are some key points from the full article:-

Earlier this month, the Telegraph reported on the unusual story of an Essex taxi driver who is facing prosecution for apparently falsely claiming that an accident forced him to retire.

Michael Seabrook alleged that an accident that took place in April 2006 rendered him unable to return to work, and claimed GBP52,000 in compensation for lost earnings.

However, the insurer who Mr Seabrooke was claiming his injury compensation from, Aviva, smelt a rat and instructed private detectives to track Mr Seabrook's movements, suspecting that he was still working. They were right.

Mr Seabrook, understandably, disputes Aviva's claims but now has the further ignominy of facing possible prosecution and imprisonment for insurance fraud. His lawyer argues that he's suffered enough, both in terms of the legal costs ruling and his ill health (although he can still work, the accident apparently did have some effect upon him).

Aviva's solicitor, John Lezemore, said his client was taking the action against Mr Seabrook to act as a 'deterrent' against other fraudulent actions and criticised the culture of 'no win no fee' claims:

"The advent of accident management companies and no win no fee lawyers means that all fraudsters need to invest in their fraud is a day of their time at trial, if the case goes that far."

'No win no fee' seems to be some sort of pariah in common parlance: to most people it conjures up images of seedy, greasy conmen enticing chancers to make a claim for something that hasn't really happened.

With CFAs this doesn't happen: if the solicitor loses, he has to write off his fees. This way, lawyers these days tend to be that little bit more honest about the projected outcome of their case.

Sure, no win no fee may be flawed, and there are going to be those members of society who will always try to take a short-cut through it to get an easy buck, but it has a valuable place in Britain, for the time being.

Hi "nuisance and ccfa funding"... you forgot to add these type of insurance policies have "policy exclusions" written into them... one common one is "Disputes you are aware of, or should be aware of".... hi m*ther f8cker Suleman, pay the money back now! My car insurance is rocketing and its Pakistanis like that who are to blame!
