This general statement says that a person cannot be denied life liberty or security of the person without the principles of fundamental justice being followed. The supreme Court of Canada has said that the principles of fundamental justice are to be found in the basic tenets of our legal system and that it is up to the courts to develop the limits of these tenets. In other words the courts will decide on a case-by-case basis whether a tenet of fundamental justice has been violated. For example the ontario court of appeal has held that the right to remain silent when an offence is being investigated is and always has been a principle of fundamental justice. Therefore the police violated this right when an accused was told that he would be held until the keys to the car that the police believed he had stolen could be found. In other words he would be held until he gave the police the keys or told the police where the keys could be found. The supreme court of Canada held recently that a provincial law which imposed a minimum seven-day sentence on a person who was driving with a suspended licence even though he was unaware that his licence had been suspended violated a principle of fundamental justice. The Court also said that s.8-s.14 are specific situations involving the deprivation of life liberty or security of the person sections 8, 9 and 10 concern pre-trial procedure 8.Everyone has the right to be secure against unreasonable search or seizer. 9. Everyone has the right not to be arbitrarily detained or imprisonment. 10.Everyone has the right on arrest or detention {a}to be informed promptly of the reasons therefore,{b}to retain and instruct counsel without delay and to be informed of the right, and {c}to have the validity of the detention determined by way of habeus corpus and to be released if the detention is not lawful. Sections 11, 12, 13, and 14, relate to trail procedure. For your Info all the Sections In this Artical is repetriated from United Nations Charter, U.N. call it Article 1 to Article 14. Here in Canada is Called Sections in the supreme Law of Canada The Constitution therefore this Articles applies into both National as well International Law. Bravo.

A power struggle at the External Security Organisation has dramatically turned nasty with the Police confirming that they are investigating an alleged plot to kill the deputy Director General, Mr Emmy Allio. Mr Allio who told Daily Monitor that his detractors had plotted to kill him during the riots said he has received various death threats and is worried that he could ‘die anytime’.

Senior spy summoned over murder plot
The Police Criminal Investigations Directorate has summoned a top official at the External Security Organisation following allegations of a plot to murder the deputy director General, Mr Emmy Allio, Daily Monitor has learnt. News of the decision to summon the top official, approved by the Inspector General of Police Maj. Gen. Kale Kayihura, who is supervising the CID investigation, came on the backdrop of a statement by the coordinator of intelligence services dismissing the murder plot as “hogwash”.

THE Uganda Law Society has honoured four of its members for their contribution to the legal profession.

Prof. Abraham Kiapi, who passed away in 1993, was honoured posthumous for his contribution.

Kiapi was the first dean of the faculty of law at Makerere University in 1972, four years after it was formed.

A law graduate from the University of Dar-es-Salaam and Columbia Law School in the US, Kiapi attained a doctorate at the age of 32, making him the youngest Ugandan to achieve the academic qualification at the time.

Apart from authoring several books and papers, he was also a visiting professor in several universities.

In 1970, Kiapi controversially awarded an honourary law degree to the then president, Idi Amin.

Kiapi’s daughter, Evelyn Kiapi, received his accolade.

Others honoured were former Chief Justice Wako Wambuzi, deputy speaker Rebecca Kadaga and veteran advocate Godfrey Lule.

Wambuzi served twice as chief justice, first from 1979-1980, then from1986-2000.

Kadaga was one of the first women to set up a law firm soon after her admission to the bar in 1982.

Lule was honoured for mentoring a number of lawyers in criminal and commercial law.

The awards were announced at a dinner at the Imperial Royale Hotel in Kampala recently.

Society president Bruce Kyerere said the awards ceremony would become an annual event.

He commended the four winners for setting a good example in the profession.

Akena Adoko is dead

The former director of Uganda's first intelligence agency, the General Service Unit, Naphlin Akena Adoko, is dead.
Akena Adoko died at the King George Hospital in London at 4:00a.m.(7:00a.m. Ugandan time) today, Friday Jan. 8, 2009. He had been ill for more than two years with cancer of the kidney.
Akena Adoko, a lawyer and cousin to the late President Milton Obote, became the head of the GSU in 1964 when it was created. He trained in intelligence gathering in Israel before assuming the task. He came to possess some of Uganda's most tightly-guarded secrets.
When in Dec. 1969 there was an attempted assassination of Obote at Lugogo in Kampala, the GSU in its investigations of the incident established that the Commanding Officer of the Second Infantry Brigade at Masaka, Brig. Perino Okoya, had tried to take advantage of the confusion and stage a military coup.
The GSU immediately created a unit within the organisation called the State Research Bureau, to gather intelligence on senior military and government officials to forestall a possible coup next time.
One of the first officers in this newly created State Research Bureau was a recent graduate from the University of Dar es Salaam called Yoweri Museveni.
It was the State Research Bureau of the General Service Unit that shot dead Brig. Okoya at his home just outside the northern town of Gulu on Jan. 25, 1970. The assassin, when he heard Okoya's wife Anne bathing in the courtyard of the house, mistook her for Okoya and shot her dead.
He later also shot Okoya dead after Okoya came to the scene to find out what was going on. Information available to the Uganda Record suggests that the man who shot Okoya and his wife dead himself died in 2007 or 2008.
Research by the Uganda Record in 2008 established another secret of Ugandan history --- the role of Akena Adoko in the 1971 military coup that brought Idi Amin to power.
Alarmed by Obote's move to leftist Socialist economic policies, the British government quietly contacted Akena Adoko, who had always felt a certain envy toward Obote, to become Uganda's new head of state in a coup the British planned to stage while President Obote was in Singapore to attend the first ever Commonwealth heads of state summit.
However, details of that coup accidentally leaked to a Uganda Army lieutenant, Isaac Maliyamungu, who passed the information on to Amin and a section of the army staged what was in essence a counter-coup, leading to Amin's rise to power in Jan. 25, 1971.
According to the Uganda Argus newspaper's edition of Dec. 7, 1971, Adoko had flown to Bombay (Mumbai), India for a meeting with Obote who had stopped over in India on his way to Singapore.
Obote then flew on to Singapore while Adoko flew to London.
The night before the coup found Adoko at the home of a Ugandan in London celebrating what they thought would be a coup that night that would topple Obote, little knowing that Amin had moved to stage a counter coup and by the following morning would be Uganda's new leader, not Akena Adoko.
Bitter about what had happened, Akena Adoko remained in exile.
On May 13, 1971, a Uganda government spokesman announced a reward of one million shillings to anybody who would bring back alive Milton Obote and 500,000shs each for Akena Adoko and the former Uganda Army adjutant-general, Lt. Col. David Oyite-Ojok. They were accused of working to sabotage Amin's regime.
On May 30, 1971, Amin said he had information that Akena Adoko, was in Bukoba, Tanzania, training guerrillas to fight Amin's regime

MAKKAH: A number of Islamic organizations took part in a forum organized by the Muslim World League (MWL) recently to coordinate efforts in support of the Prophet Muhammad (peace be upon) against smear campaigns.

Abdullah Al-Turki, secretary-general of the MWL, commended the efforts of Islamic organizations in defending the Prophet by publishing books about his life and message and organizing seminars and conferences.

"Propagating Islam is the duty of every Muslim and this requires proper knowledge of the Qur'an and Sunnah," he said, urging Muslims to study the Prophet's life and teachings.

"This will give Muslims an idea about the Prophet's life and his great qualities, and encourage them to stand up in his defense," he said.

Al-Turki spelled out the MWL's efforts to defend the Prophet, adding that it has set up an international center for this. "Our center has carried out a number of projects to realize its objectives."

He also urged Muslim organizations to coordinate efforts while conducting various programs such as seminars, conferences and exhibitions in defense of the Prophet.

Adel Al-Shiddi, secretary-general of the MWL center, said it is to present a working paper at the forum on future joint activities.

The forum called for the establishment of media centers in Western countries to monitor smear campaigns against the Prophet and properly answer them. The forum also called for surveys on public opinion about the Prophet.

Suleiman Al-Batahi, representative of the International Committee to Support the Final Prophet, called for the organizing of special programs in Western capitals for the purpose.

He also called for the setting up of legal offices to take action against those who attack the Prophet. "These offices can also mobilize support to counter moves to spread hatred against Islam and Muslims with the support of friendly countries, making use of good economic and political relations with those countries," Al-Batahi said.

Hassan Ahdal, director general of media and culture at the MWL, emphasized the importance of setting up a specialized center to monitor media attacks against the Prophet and provide suitable answers.
