Marchman Act

I am absolutely amazed the court did not grant the Marchman Act petition in this matter and clearly would have utilized the right to take "exception" and bring the matter for hearing at the Circuit Court level. The following is information that families can read to better understand the Marchman Act Process:

A Family Guide to the Florida Marchman Act

Let me first introduce myself. My name is Raymond G. Ferrero III, Esq. I am an attorney and Partner with the Florida based law firm of Addiction Recovery Legal Services, LLC. I am also the Executive Director of Heath Affairs for Nova Southeastern University’s Health Professions Division and a past Gubernatorial Appointee to Florida’s Statewide Drug Policy Advisory Committee.

It is my great pleasure to be writing this brief overview of the Florida Marchman Act. For over a decade, I have been actively involved in Florida’s mental health community and Marchman Act Courts. I have witnessed the Florida Marchman Act develop from what was once a little known (and, little understood) law into what is now being recognized not only throughout Florida, but nationally as a family’s greatest tool for addressing crisis substance use, abuse and addiction within a family unit. Professionally, I take great pride in my ability to honestly inform families that are struggling with a loved one in crisis that the Florida Marchman Act is the answer that they have been seeking. The Florida Marchman Act, when properly litigated by an attorney with a full understanding of the nuances and powers of a law, is a process that will:(1) establish consequences and hold an addict legally accountable for their continued substance abuse; and (2) empower families with a mechanism to interrupt a substance abusers stranglehold on the people around them. Let’s begin our overview of the Florida Marchman Act…http://www.marchmanactblog .com/

Mr. Ferrero, I thank you for your comments and I also never understood how the court did not grant the family's request after the amount of overwhelming evidence they had that a serious problem existed, including the third baby being born addicted. I know you cannot answer to the specifics of this case, but I appreciate your brief explanation of the law.

OMG! OMG! OMG! Does she stay in rehab? Where the hell else would she go? Will Howard's wife make room for her in their bed?
Will Alex hitch-hike back to Florida?
Next Thursday, February Sweeps Week! True to formula, heh, Dr. Phil!
Also I understand DP is kicking off Sweeps Week by having on the parents of Lisa Irwin, the missing baby in Missouri. The parents won't talk to the police to help them find their daughter, yet they're talking to Dr. Phil? Like that's going to help...the drunk mother probably rolled over on her daughter and smothered her to death, then had a friend get rid of her body before daddy came home.
That Lisa Irwin case is weird. They STILL haven't found her? What about the man carrying away the baby? Maybe somebody does these jobs? Last client Casey Anthony maybe?

Hi Nina! Good to see u back. But this is a state law, am I right? So if you're in New York, the legislature would have to enact its own version. Maybe other states have, not my field. No reason why you can't look up this type of statute for any state.

Hi Greenwitch! Yes I know it's a state law, just never understood how the hell the court did not mandate treatment for Alex when her whole history was well documented thanks to Dr. Phil and his SWEEPS shows! What on earth does a family have to do to prove their family member is in danger? Oh well, it's a moot point now that she is in rehab. Hopefully they will keep her there a long time, and then release her to a halfway house till she gets on her feet. I know we have all been angry at Alex and it's difficult to understand the hold addiction has on a person when you haven't experienced it. But, I do wish her the best and hope she can make up all this lost time with her children in some way.

Off-topic, but the Irwin show is supposed to be Friday, after the Alex episode. Last news I read, who knows if it's true, was that cadaver dogs reacted to a place on the parents' bedroom floor, but police couldn't establish if a deceased person had been on that piece of carpet. Mother Deborah Bradley failed a lie detector test and refused to speak with police again. Doesn't sound promising that baby Lisa is still alive, does it?

If this was an accident, why not be honest. The mother was drunk and would be charged with neglect, not who knows if she'd get any prison time. Sounds like many people would rather have the media attention and money from writing a book than doing the right thing. Wonder if the guilt that eats away at them like a cancer is worth it? Although sociopaths don't experience guilt.

Many of us were fascinated that Alexandra Harrelson was not found to be impaired by her drug use by the Florida state specialist responsible for establishing this impairment. Alex's mother claimed that no drug test (urine, blood) was performed, and only Alex's demeanor, and ability to respond to a few questions were considered in this evaluation.

How can the Marchman Act be considered effective if it is so easy for the addict to circumvent it? How can parents of an adult daughter force her into drug rehabilitation if she can convince evaluators that she can function under her current circumstances?

As a subject matter legal specialist, I'm asking if you would please, summarize an explanation for us.

Hmm impressive.
I usually don't clock on links, but then saw that Slayer did so i checked it out.

Phoney finally admits that Alex is in Rehab !!! HAHAHAHAHA

Good thing the people here have some with inside information that Dr. Phoney & The Stehl Family won't share, to keep us updated on the REAL truths. Not the candy coated b.s. that they love to throw out there.

Wonder how BMT (Brittany Mitchell-Triolo) is doing>>>>>

Feel free to come back on if you can Brittany. Your posts were very interesting, to the point, and best of all......NO cover-ups !!!

I think I remember The Stehl's laywer believed that she had to further down the rabbit hole before the law could be enforced. Which is probably why all the gift cards, gas cards and hotel rooms were probably taken away. Once she lived her life without any help from anyone whatsoever, wow she was suddenly homeless, dirty, living in the gutter doing god knows what to get food drugs etc. I get why Dr Phil put her in a hotel room, he wanted her to have a roof and be safe. But to me that just enabled her more. When she showed the cameras rounnd the hotel room she was so freakin ungrateful for that free roof it was sickening. The gifts should have stopped years ago, it just made her worse. She was probably bragging to her drug buddies how she could get stuff from the producers that they could use, even if it wasnt cash. Marty even admitted in the intervention that he gave her cash. I guessed everyone stopped giveing her anything at all. And then voila, homeless dirty grovelling and finally gets she needs rehab. She would be totally losing her looks in this state and then HELLO men arent into her anymore except maybe for a pathetically cheap trick. Rock bottom, no man Marchman Act? Now rehab. I dont think she should go near her children until sober fo a long time. If she sees them she'll mess them up. Baby Michael wont even know her. AND if she gets a standing ovation for going into rehab from a Dr Phil audience, then I'll be puking in my hands.
Who is baby Lisa Irwan? Another American case for me to look up. Well it is a rainy day. This case sounds so sad. Why dont these people put their babies up for adoption?

I assume this attorney knows what he is talking about if 'm apractices in this area but Dr Phil's show is not evidence and if Alex is a sociopath (big IF) they con judges every day and that family can mess it up good. If Alex doesnt listen to anyone else, she probably wont listen to her lawyer after all she knew better than those doctors. I 'm a lawyer and the system doesnt function perfectly by any means.

That's not good...though at least Erin answered you. Sounds like Howard's bitch-wife tossed Alex out when she got out of jail. Doesn't sound like they're the kind of people who care what happens to a pet cat. These kind of people are sickening! Alex should never have adopted a kitten when she knew her situation was so precarious!
Just as we've said before -- Alex doesn't think past the getting pregnant part, any female can spread her legs, only real women are mothers!
Alex tweeted that the kitten was only 5 weeks old and way too young to be away from its mumma. But what about your kids, you dumped them at your mothers house when they were tiny. Were they too young to be away from their mother. What am I talking about, shes not even a mother

I dont mind Chris. Well he's better than the others. Looks like Howard got over Alex pretty quick. If she was homeless and dressing out of garbage cans, Im assuming he wasnt still with her. Maybe the wife beat her up and Howard was the prize.

The whole family (Tony's and Alex's) is one big prize package. Why does Phil never have that Harvard attorney, Areeva Martin, on with these people. She is nobody's fool. Seems pretty good about telling it like it is (expression from the 60s).

What is up with Greenwitch's posts recently?

The pomes or riddles? Strange??????

Anyway... I just saw another anoying advertisement/preview for the or should i say one of the shows, on Alex.
What a joke.

How is a person supposed to get better, off of drugs if you keep sticking a camera in their face?

This has become unwatchable. I already know what's happening.

As mentioned months before, it was posted that she is in Rehab, paid for by Dr. Phoney.

Now, he decides to start airing this train wreck...( Sorry to borrow your name there, other poster).

Phoney is going to act like alex just went into rehab, when we all know she has been in there since around Thanksgiving.**News Flash, she's still in there.

Good for her. Even though i can't stand the family, & am siding with Nina on Dr. Phoney.
Seriously, if he cared soooo much for her & her family, why couldn't he just leave well enough alone, pay for the rehab ( he already made enough money off of airing her "life").

Now, he & Erin have a bunch of before rehab videos ---how sick can they get shoving cameras in her face before???? For t.v. profit?
And he is going to lie and make it look like she is waffeling on wether ro go or not, when she is already there & has been.

Will milk ever dime out of this.

Leave the skank alone already. She is there. 90 o/o or more of people that have gone to treatment relapse. What are those odds going to be if you don't leave her the F alone.

Enough !! I'm sick of seeing her ugly face and her mothers (Erin) every time i turn the channel.

Maybe it's all of the lies by DP, i don't know. Just sick of it already. Move on to another family to destroy. Oh, I mean help.
