If you are a BRAC transferee or moving into the state you need to be aware there are no state laws re: real estate disclosure or HOA disclosure. You may find yourself in a home with major defects w/ no recourse or a member of an HOA run by a developer who has stolen the HOA funds or mortgaged the community amenities w/o your knowledge. Prior to moving into the state do your research into the practices of real estate agents and HOA issues. Require a full disclosure on all issues with a written report signed by the agent and/or HOA Board. Verify every fact prior to closing and make the contract contingent on your examination of all records, Covenants and Restrictions, and HOA BY-Laws and a detailed home inspection.
