The Reko Diq case

Published: April 7, 2011

The Supreme Court said on Tuesday that it would look at the Balochistan High Court judgment in the Reko Diq case, and would pronounce a decision that would leave the representatives of the Baloch people to decide. The SC’s observation that the project did not appear to be a joint venture showed that it did not see the Tethyan Copper Company Pakistan as primarily a partner of the Balochistan government. The TTC, a joint venture itself, of the Barrick Gold Corporation of Canada and the Antofagasta Company of Chile, is supposed to be in a joint venture with Balochistan over the Reko Diq mining project, but this not only came to the SC in the form of an appeal from a Balochistan High Court decision, but also on certain petitions invoking its fundamental rights jurisdiction. The case seems to involve corruption at the highest levels. There have been allegations that the deal is tainted, and that improper pressure was exerted on the provincial government to grant the lease.
The Supreme Court, which has committed itself to end corruption and the recovery of all looted money, was told by noted nuclear scientist Samar Mubarik Mand that the ore extraction and refining could be done indigenously. This apparently contradicted the TTC claim that it had exclusive technology through which to exploit the lease. This also showed how the brain drain occurs, and also how resources are given away to foreigners by our own people, and how our own people were then employed by them to exploit those resources. The case illustrated the relationship between the companies that exploited these resources, and the governments of the areas concerned, which seem more concerned about foreign corporations than their own people. http://www.nation.com.pk/pakistan-news-newspa...

Reko Diq case: SC suggests dismissal of BHC verdict
Staff Reporter

Islamabad—The Supreme Court (SC) on Tuesday said that the Balochistan High Court’s verdict in the Reko Diq Case was becoming a hurdle in deliverance of justice.

The apex court suggested the applicants and respondents to consider the nullification of Balochistan High court’s decision before proceeding further. Chief Justice Iftikhar Muhammad Chaudhry, who was heading the SC bench hearing of a suo-moto case of the Reko Diq issue, observed that the high court’s verdict was a great hurdle and suggested both parties to consider its nullification and submit their reply till Wednesday. The Balochistan government had allotted the rights of mining to the Tethayan Company which conducted all the digging process at the site. The hearing was adjourned till Wednesday (today).
