The verdict came down Wednesday following two days of testimony.

The five were arrested in August of 2011 after undercover officers went to the fights and documented what they saw.

The fights reportedly happened at a home in the Speake community.

Defense attorneys argued that cockfighting is a sport, saying that George Washington, Thomas Jefferson and Abe Lincoln all were known to be involved in it.

They also tried arguing that since a chicken doesn't have four legs and fur, it's not an animal - so animal abuse charges wouldn't make sense.

The jury seemed to hinge on whether or not the fights were on private or public property.

"In short, if you fight cocks in a public place, then that's a violation of the law. The flip side of that is, theoretically, well, you can fight at a private place," said Lawrence County District Attorney, Errek Jett.

The judge told jurors to ignore the argument that chickens weren't animals.

HISTORY LESSON ON ANIMAL RIGHTS AND TYRANNY

“Those who do not remember the past are condemned to repeat it.”

Hitler's Nazi Germany was marked by a preoccupation with "animal rights." Hitler's Third Reich passed numerous animal protection laws, such as declaring that shoeing a horse was cruel, and declared an end to dissection. This reduced Man’s status to that of animals, and justified treating men as animals. Before the war was ended, the Nazis stepped up experiments on the best way to castrate a Jew without anesthesia, and turned countless men, women and children into lampshades and soap. These Nazi actions were justifiable by their belief that it was possible to "...increase the moral standing of animals and decrease the moral standing of people, thus integrating human characteristics to animals... elevating animal life to the level of cult worship...which would lead to the spiritual and ideological changes necessary... for a new national identity."

The real political objective of “animal rights” is to eliminate "unalienable rights," and to make way for all these other supposed rights and pervert our Bill of Rights to the point where only the perverted are protected. A favored socialist strategy is to separate the population from common sense and its own laws by bringing about chaos, clouding real issues, then bring about “change” through gradual “legislation from within.” Ruling by planned crisis is the favored method, as this short-circuits the brain’s ability to think and reason clearly about true issues. This planned chaos (such as “animal cruelty,”“puppy mills” and “cock fighting”) is designed to rob the nation of its creativity and life force, degrade human existence, make everything seem uncontrollable and bad, which then allows the introduction of a tyrannical form of government.

The Gestapo was first used by Goring to do away with political opponents. A "temporary" state of emergency was declared after the Reichstag fire, but was never rescinded. This allowed the Gestapo to enforce conformity at every level of society. Block wardens monitored their neighbors, and children were recruited to inform on their teachers and parents. The Gestapo was authorized to hold people in "protective custody" which was really arbitrary arrest and imprisonment. At first, only political prisoners were taken under the guise of "preventive protective custody" and placed in SS-controlled concentration camps; later, anyone was hunted down and taken who was deemed to not fit in with SS and Gestapo vision of a perfect Aryan society.("SS" came from Schutzstaffel which means "elite guard").

Today we see this same conduct and set of circumstances appearing in some of our civic institutions. The only way for one man to achieve dominion and control over another is through the darkness of IGNORANCE. Let’s get educated about our own laws, so that tyranny cannot gain a foothold in America, and so that we can once again have “happiness and good government flowing forth” as paraphrased by all our early education laws. We do have some beautiful laws. Let’s learn them, and insist that our civic institutions obey them for the good of our nation. God Bless America.

Cockfighting could earn millions for state

Regarding The Californian's May 26 editorial, "Two cockfighting bills that were long overdue": On behalf of the thousands of game-bird hobbyists, I'd like to say that anyone who has been raised around game birds knows that a rooster cannot be forced or trained to fight; this is a natural instinct that was instilled by God.

Animals that are forced to do what does not come naturally to them is cruel. Were horses meant to be ridden? Are the animals in the circus, zoo or rodeos meant to be used for our entertainment?

When it comes to cockfighting, who are these "experts" who claim that these chickens are "trained" to fight? What real proof is there that connects drugs, gangs, prostitution and gambling to this activity? Just to go Vegas, it's all there. Raising and fighting game birds requires money: money for feed and vitamins, money for building supplies for the pens, money for items to provide their chickens the best care; WIC or EBT benefits cannot be used to purchase these items.

The so-called "barbarians" who participate in this activity are working individuals who have jobs and pay taxes. If there are more than 50,000 cockfighters in California, then just imagine the money the state could produce if it was made legal and each of those 50,000 people had to purchase a yearly permit to fight: a $100 permit times 50,000 people equals $5 million or a $500 permit times 50,000 equals $25 million. Prior to being banned in Louisiana, cockfighting was a $150 million industry.

10 reasons we need to legalize Cockfighting

1. Legalizing Cockfighting is the only way to save the Gamecock from EXTINCTION. THE ONLY WAY

2. It promotes brother hood, Rich Poor, Black White, Christian non Christian, Man Woman, Young old, American non-American.

3. Legalized Cockfighting would bring in millions in taxes, permits, and licenses, the money could go to social programs to take care of the elderly, children, disabled, Etc.

4. Legalizing Cockfighting would produce thousands more jobs like family run feed stores, hotel, gas stations, restaurants, farmers, Etc.

5. Legalized Cockfighting would put Human life and livelihoods above that of a chicken

6. Legalizing Cockfighting would free up the police force, the public defenders offices, and the judicial system, all of these resources could be better utilized pursuing and prosecuting violent offenders.

7. Legalizing Cockfighting would better serve the whole poultry industry, It would let the vast number of Cockers work with the USDA, State Agriculture departments, medical and poultry science departments to find better ways of disease control, In genetics research and the overall health in all poultry

8. It can’t be prevented: There’s a reason it’s called “one of the world’s oldest sports”. It’s always been around, it always will be. We might as well use it.

9. The laws are arbitrary and hypocritical: It’s okay to fish, hunt, trap, falconry, and to kill unborn babies.

My compliments to Dave Bultena for his daring article (“Time to make cockfighting legal in our state,” May 9, Page A11) on restoring cockers' 14th Amendment rights and kudos to The Modesto Bee for supporting the First Amendment right to print something that some may consider “appalling” or “obscene.”

In response to the letter “Cockfighting column was appalling”(May 14): Whether there is something wrong with cocking or not is not the point. The point is that cocking is singled out for persecution because of a lengthy campaign to demonize a minority class of people. The courts have held that moral disapproval is not a reason to deprive one of Constitutional rights. To correct the writer, gamecocks are not helpless or defenseless. Unlike other legal sports, cocks are matched by equal weight, age and weapon. Cocks fight because that is the instinct that God put into them. No power on Earth can make a cock fight if he doesn’t want to.

Other legal animal uses – hunting, fishing, trapping, falconry, animal slaughter, etc.– involve the victimizing of an unwilling, helpless, defenseless creature that wants no part of the “game.”

Spending limited resources to squelch one of the oldest sports known to man – that can’t be stopped – seems unwise. We should bring it into the light by legalizing, regulating and taxing it. California could realize millions of dollars and at the same time eliminate the attendant crimes that sometimes are present at clandestine gatherings.

“Once Upon a Time” the Humane Society of the United States was organized for a noble purpose. However, in recent years the Humane Society of the U.S. appears to have lost its way, and has actively demonized so many decent and caring individuals who have anything to do with Animals. Consequently, the fundamental Principles and Rights of Humans that our Forefathers set out in the Declaration of Independence and the U.S. Constitution, are being desecrated by those who believe the Rights of Animals are greater than the Rights of Humans. And yet, a review of the words set out in the Declaration of Independence and the U.S. Constitution reveals no mention of "Animal Rights."

Human Rights are sacrosanct, as well they should be, and no person and no organization have an absolute right to desecrate the God-Given Rights of Humans. That is why I believe that all who believe in the Guiding Principles of the Declaration of Independence and the U.S. Constitution need to work in concert to "Right the Unrightable Wrongs" of the Humane Society of the U.S.

Each of us represents the "Power of One." And each of us has the "Power" to communicate with others, and to share with others how best to "Right the Unrightable Wrongs" of the Humane Society of the U. S. If each of us exercises the "Power of One," the multiplier effect of our cumulative actions will become an insurmountable force that will ensure that our God-Given Rights are once again restored, revered and protected. Let us all work together as "One" in order to restore the integrity of our Rights as so eloquently summarized by the immortal words of "One Nation, Under God!"

Cockfighters found not guilty

MOULTON — One juror, who on Wednesday found five men not guilty of charges related to cockfighting, said she was disgusted with the verdict.
“It was just terribly, terribly sad,” said JoMarie Bartlett of Trinity.
“Everyone in that room was disgusted that we had to vote not guilty,” she said.“But the way the law reads, we had no choice.”
Joseph Lynn Holmes, 36, of Hanceville; Larry Dale McCroy, 53, of Hanceville; Zackary Clay McLeroy, 33, of Cullman; James Russell Garnett, 34, of Vinemont; and Grady Darrel McCroy, 54, of Cullman faced charges of cruelty to animals and gambling on cockfighting.
The charges were the result of a raid of a cockfight at a residence off Lawrence County 81 at the edge of Bankhead National Forest.
“I’m just glad we left it up to the jury,” Larry McCroy said after the verdict.“I think they did the right thing. It was justifiable.”
According to the Code of Alabama,“Any person who keeps a cockpit or who in any public place fights cocks shall, on conviction, be fined not less than $20 nor more than $50.”
However, Bartlett said,“If it is in a private setting, by law it is not against the law to cockfight. That negates the animal cruelty right there.”
Bartlett said she spoke with Rep. Ken Johnson, R-Moulton, and had contacted People for the Ethical Treatment of Animals about the 1896 law allowing cockfighting in a non-public place.
Johnson said any proposed tougher cockfighting law probably won’t gain much traction in the Legislature,“considering all the important stuff that has got to be addressed.”
“From what I’m aware of, it’s not a big problem in Lawrence County or in the rest of the state,” Johnson said.“As I understand, it was an issue of private property versus public property, and that’s a careful balance that has to be maintained.”
A bill that would raise the penalties for cockfighting stalled in the Senate this year. The bill passed the Senate 21-5, but Senate President Pro Tem Del Marsh, R-Anniston, called for a motion to carry over the bill for further consideration, effectively killing it for the session.
The bill would have increased the fine for cockfighting from $50 to $6,000 and up to 12 months in jail. The Alabama Gamefowl Breeders Association was opposed to the legislation, because the bill would prevent the breeding of birds that potentially could be used for cockfighting.
Lawrence County Drug Task Force investigator Shannon Holland was the only witness called during testimony. Holland testified that with a confidential informant, he attended the event Aug. 6 and Aug. 7, 2011. He said admission was charged and gamecocks fought in an octagon-shaped ring with bleachers and chairs on both sides. He testified he saw several dead and injured gamecocks, and saw all the defendants handling the birds before or during fights.
The jury viewed video Holland captured on his cellphone of a cockfight and of injured birds.
The jury deliberated about three hours and returned to the courtroom asking Circuit Judge Mark Craig for access to a dictionary definition of a public place. Craig replied the jury must use the Legislature’s definition, which defines a public place as a place to which the public or a substantial group of people have access, such as schools, parks or playgrounds.
Craig said an example of a private dwelling is a residence. However, even if numerous people have access to a location, the location can still be private if attendance is by specific invitation only, Craig said.
The defendants’ attorney, Mark Dutton of Moulton, said Tuesday the cockfight was held on private property.
Lawrence County District Attorney Errek Jett said though the cockfight was at a residence, the event wasn’t private and was open to the public because Holland was able to attend even though he knew no one there other than an informant.
