It's pretty cut and dry.
That rule only mentions Congress, it does not bind the government, or anyone else from doing so, including State legislators. Unless there is a similar clause mentioning these entities.

You have to keep on watching, till it forms a new plant, blooms, and then makes new mung beans, much like the green beans I grow every summer, or tomatoes, or squash. They make themselves. I put a seed in the ground, give it good soil, sun and water, and a plant comes up, reproduces and has a fruit with self assembled seeds for the next generation.

I didn't catch even one little god out there in my garden putting seeds into the plants.

Raw materials were pulled out of a medium and assembled into a sprout. Buck's definition included this: "assemble - to connect or put together the parts". It is unbelievable that you and Buck have to be told this.
