I think with certain individual it should be..and there are plenty walking around! LOL!
In this wonderful state of AZ that I live in (temporarily) we have a stupid driver law!! Believe that one..it is true!

While criminalizing it does sound tempting, I think that an even better idea would be to just make it painful. The more stupid the comment or act the more it should hurt. It could range from like a static electricity shock for mildly annoying comments to fully charged taser for like the idiots that rob banks and write their stick up note on the back of their personal check or call the cops to tell them someone stole their stash...

Yes, stupidity should be against the law.
Harmless acts of stupidity, like jay-walking, should be treated as a misdemeanor, maybe a $200 fine, max.
Gross stupidity should be punishable by deportation to country of origin, assuming, of course, country of origin could still be determined.
Needless to say, stupidity cases would be decided by a judge; trial by a jury of peers would be ... well, stupid.
