P2P users as part of some conspiracy with the prime movers of a global distributed infringing operation is novel but was always destined to fail as a legal strategy.

P2P users can quite properly be convicted of aiding and abetting the operators of p2p networks. There is well established case law to this effect and the proposition is can not be seen as a controversial legal approach.
