He made it clear he would NOT consent to adoption when his girlfriend was pregnant. The second he learned the baby had been born, he hired a lawyer and filed for custody, and was awarded full, permanent custody of his child. Unfortunately by that point the adoption agency had conspired to have the baby snuck out of the state to try and use the laws of another state that didn't give as many rights to fathers. It has taken 18 months for it to make it to the Supreme Court in Utah because the courts move slow but he began the legal action as soon as the child was born.

Its not 'kidnapping'. It's only kidnapping if the child was taken without permission or forcibly removed without permission. Since this father was not in the picture when the child was born, he gave up his rights. The mother did what she thought was best and gave the child up for adoption. This Utah couple and the mother went though the appropriate legal channels. Not only that, if the 'father' wanted to see his child, and he had a picture of her, why did he wait so long to (19 months) to decide that he wanted to see her? I'm sorry, you can just decide that you want to be father AFTER 18 months. If he wanted to be a father to this little girl, he should have decided that the day she was born, 18 months ago. Plus if you waited this long to decide to be a father, whats to stop you from deciding that you don't want to be a father after all if you don't like it? Stop putting this family through turmoil because of your selfishness. This child has a good home, leave her be. If you want to see her grow up, maybe ask for pictures or something, but don't take that child out of the only home she has known and where she has been loved.

Its also called, 'get married before you have a child or while the mother is pregnant'. That way these fathers would have a chance at getting custody of the child or a say.

Jes - the father WAS in the picture when the child was born, he went to court immediately, it has taken this long for his appeal to make it to the state supreme court. He objected to the adoption when she was born so they hid the baby in a hotel room so they could sneak her out of the state as Virginia law required his consent. He wanted to be a father to his little girl from day 1 and made that VERY clear and the adoption agency and kidnappers conspired to sneak the child out of the state in hopes of a more favorable ruling in Utah. Please read up on this case before accusing this poor man of doing something he DIDN'T do. You don't see to realize how slow the courts move!

John filed for custody 4 business days after Emma was born. The Zarembinskis' have not been able to adopt her due to that pesky federal parental kidnapping act. The SCOTUS is reviewing this case and the Zarembinskis' have no shot at keeping her. They belong in jail.

It was 4 business days after Emma was born that he filed for legal custody AND he is on the original birth certificate. She is not adoptable.
