White House nixed nondiscrimination order over lawsuit fears

President Obama's refusal to sign an executive order banning discrimination on the basis of sexual orientation or gender identity was based partly on the fear of getting tied up in litigation, according to one activist who attended a Wednesday meeting with administration officials.

Tico Almeida, founder and director of Freedom to Work, told POLITICO that the White House made "excuses" for not issuing the order in a closed-door meeting with activists — pointing to the possibility of being entangled in lawsuits over the order.

According to Almeida, the White House said they were concerned that an executive order would come under legal assault. Almeida said he noted that a similar executive order signed by President Lyndon Johnson banning discrimination on the basis of race, color, religion, sex and national origin also came under legal assault -- and all the cases were rejected summarily.

"They were grasping for reasons," said Almeida, who helped draft a similar bill called Employment Non-Discrimination Act when he worked as a staff attorney in Congress.

"Each and every one of those challenges was defeated and totally rejected by the federal courts," Almeida said about Johnson's executive order. He said he asked the White House counsel representative at the meeting to point to a single case that might show that the order was on shaky legal ground — and she could not.

Dems on defense in war over women

Democrats played defense Thursday, after an unforced error by veteran Democratic strategist Hilary Rosen criticizing stay-at-home mom Ann Romney.

The flap also elevated one of Romney’s most powerful surrogates — his wife, Ann, who has been effective on the campaign trail and whom the campaign hopes to deploy even more powerfully in the general election.

White House press secretary Jay Carney was peppered with questions about the flap at a news briefing. And it knocked Team Obama off message.

It also prompted conservatives to rally behind an all-but-assured GOP nominee.

Nonetheless, while Rosen’s remark was careless — and condescending in tone and framework — it was yet another episode in a season of outrage, real or hyped, that has dominated this cycle.

The flap began on CNN on Wednesday night, ricocheted across Twitter overnight and landed back on the cable networks Thursday morning with appearances by Rosen, who doubled down on her comments, and Ann Romney, who defended herself and said women’s choices need to be respected.

Dem operative criticizes Ann Romney, ignites storm


Hilary Rosen, a Democratic operative with SKD Knickerbocker, touched off a Twitter storm tonight after she went on CNN and said that Ann Romney has "never worked a day in her life."

The statement was tweeted and retweeted, with a number of people condemning the statement as an attack on the candidate's wife, who was a stay-at-home mom who also raised the couple's five boys, and who has suffered from MS and breast cancer.

Ann Romney, who is widely praised as her husband's most effective surrogate, took to Twitter herself for her first-ever post, saying, "I made a choice to stay home and raise five boys. Believe me, it was hard work."


Rosen's firm also employs Anita Dunn, former White House communications director, and worked on the Obama campaign in 2008. Her critics on Twitter described her as an "Obama adviser," just a bit of a stretch in description, but not enough of one for some critics, especially after Democrats have hit Republicans for guilt by association with people like Rush Limbaugh for months.

Crime City of Chicago enforcing Curfews now!


Mayor Rahm Emanuel went on the defensive Thursday about a surge of recent homicides in Chicago and questioned why new law enforcement tactics hadn't been created before he was elected 10 months ago.

"You can say,'Are you doing it right,'" Emanuel said, "but the question is,'Why were those policies not done before?'"

Between the start of 2012 and April 1, Chicago Police recorded 120 homicides, a 60 percent spike over the 75 murders during the same period in 2010 and 2011.

In response Emanuel told reporters he has toughened curfew policy, dumped more resources into after-school programs and changed the way police deals with liquor stores, "a cancer in communities."

Buffett Rule or Not, Most Rich People Already Pay

According to government tax data, the median effective tax rate for the middle 20 percent of U.S. taxpayers is 13.3 percent, including income, payroll, and corporate taxes. The top 1 percent of taxpayers pay a median rate of 29.6 percent, according to the 2012 Economic Report of the President. Just one-tenth of these highest-income households have tax rates of 8.7 percent or less.

If the Buffett Rule—officially named the Paying a Fair Share Act of 2012—became law, the number of people required to pay substantially more in taxes would be relatively small. Of the 217,000 households that would be affected by the rule, 4,000 will have incomes exceeding $1 million and tax rates below 15 percent, according to estimates for 2015 by the Tax Policy Center, a nonpartisan research group. The average rate, including payroll tax, for the middle 20 percent of taxpayers will be 15.9 percent, the center projects.

Although investors including Buffett and Romney—who are now taxed no more than 15 percent on capital gains and dividends—would be “clobbered” by the Buffett Rule, says Tax Policy Center senior fellow Roberton Williams, the tax rate of top executives, movie stars, and pro athletes wouldn’t change as much because their pay is already taxed as ordinary income. High-income households with a mix of ordinary and capital income currently have rates from 15 percent to 30 percent. Their taxes would rise, though they already pay more than middle-class households.

Representative Paul Ryan (R-Wis.), chairman of the House Budget Committee, mocked the Buffett Rule as “budget pixie dust” that would pay for only 6 percent of Obama’s proposed deficit spending.


The bottom line:
The top 1 percent pay a median rate of 29.6 percent. Obama is a Millionaire and Paid ONLY 26%.
