From the great state of Mother Georgia, Jimmy Carter's state, we have the same problem here.

There's a real-estate company called TRATON HOMES that's screwing over one of it's customers. In fact, the company's even told the homeowner that the homeowner doesn't own his yard that TRATON damaged.

The lawsuit is already on the Supreme Court of Georgia's docket. Stay tuned.

The earlier post has between little and no knowledge of the correct facts of the Traton case. The homeowner tried the tacts of legal pestering to try to extract money out of Traton. The real issue with the grass (not on the property of the homeowner) was less that 1 square yard. Yet he found it resonable to sue for a seven digit number. While that may sound reasonable to some it is simply one man and his lawyer friend trying to extort money from an honest company that has been in buisness over 35 years. If we want to bash somone lets bash the ones who sue for nothing trying to intimidate through the legal system.

In my humble opinion, whether it is a square foot or a square mile, if Traton Homes damaged something, then Traton Homes should fix it. To say 'it's not your land' or 'it's not my problem' simply avoids responsibility and shows bad corporate citizenship.

Also, if this was only about a small swatch of grass, then why is Traton Homes marshalling so many attorneys to fight its own customer, rather than simply fixing the grass? I can understand why this is personal to the homeowner, since a man's home is his castle. I can't understand why a large corporation would show such bad judgment by fighting its own customer.

Next, if Traton Homes is posting to these types of sites in response to all of these allegations, then it simply shows that Traton Homes has nothing better to do with its time.

Just my humble opinion.

Funny how you mention that. The homeowner started a blog so that he could tell the world how Traton Homes has horrible customer service. Apparently, Traton Homes is upset with the blog and has threatened that it will sue the homeowner for his exercise of his First Amendment right of free speech (see www.tratonsucks.com ).

Of course, if you are consistent in your position to "bash the ones who sue for nothing trying to intimidate through the legal system," then you will have to agree that Traton Homes' is threatening to "sue for nothing trying to intimidate through the legal system."

Of course, if you think that Traton Homes has the right to sue someone for airing their opinion, then your previous post has now lost ALL credibility.

First of all, "statement" is spelled with an "e." Secondly, writing in all capital letters does not make your position any more believable. Thirdly, "any lack of legal merit in his case" is pretty subjective, especially since the damaged land is shown, clear as day, in the photograph on the website with the published opinion (see http://tratonnews.blogspot.com/2008/01/traton... ).

With that said, "any lack of legal merit" would have to be companies that sue bloggers who publish opinions about the company, just because the blogger's opinion puts the company in a bad light. If Traton Homes does sue the homeowner-blogger, then I hope that the homeowner will post that complaint on the website for the world to see, and create a firestorm similar to the debacle that resulted in JL Kirk Associates getting spanked (see http://tratonnews.blogspot.com/2008/02/traton... ).

The "homeowner lost," eh? Maybe. Let's see. Using only simple math.

Homeowner loses legal battle. Costs Homeowner a total of, say $100,000.

Homeowner sets up website www.tratonsucks.com , and writes about Builder's sucky treatment of Homeowner (i.e., Builder's own customers).

Builder makes roughly $40,000 in profits for the sale of every home (about 10% of a $400,000 home, which is my uneducated guess, but unscientifically supported by google at http://answers.google.com/answers/threadview... ).

How many lost sales will it take for Builder to lose $100,000?

Simple math dictates:

$100,000/$40,000 = 2.5 homes.

So, if Builder loses one sale per year, then it will take 2.5 years to lose $100,000.

If Builder loses two sales per year, then it will take 1.25 years to lose $100,000.

If Builder loses three sales per year, then Builder has already kissed $120,000 good bye in a year.

Now, if www.tratonsucks.com stays active in perpetuity, then the potential is one lost sale, after another lost sale, after another lost sale, after another lost sale.... You get the picture.

So, revisiting your statement that "the homeowner lost." Well, yes, the homeowner did lose. But, in my humble opinion, it is NOTHING compared to what the Builder will lose, year after year after year after year after year.... You get the picture.

Referring to the lawsuit between Traton Homes and the homeowner, it seems from the website that the lawsuit is now over.
But, it also seems as if Traton Homes reputation is already tarnished, since all of the materials that were originally posted by the homeowner are STILL available online from cached sources ( http://www.archives.org ).
Oh well, I guess that Traton Homes still sucks, and it still sucks to be Traton Homes.

Filing a lawsuit is a big undertaking for a homeowner. If Traton Homes did in fact fix the damage, then why would the homeowner file a lawsuit?

Common sense (and common decency) dictates:
(a) if you broke it, then you fix it;
(b) if the one who caused the damage makes things right, then don't waste money to file a lawsuit.

Page 7 of the document shows the damaged yard, clear as day. If that's "fixed," then Traton Homes really does a crappy job of fixing things.

I, too, purchased a Traton home that is literally falling apart. One of their representatives told me that the materials that they used to construct their front porches turned out to be faulty. Instead of fixing it, they seem to be hoping that no one will pursue it. Well, I'm pursuing. My neighbor has the same front porch, and had to completely tear the porch off and rebuild at his own expense. Traton has two new neighborhoods in this area of Cobb County. I am literate and not shy......

UPDATE: My home was built by Traton Homes in 2001. At that time, they built the front porches in my area with a product that they later knew to be defective, yet they did not inform their customers. Several of my neighbors have had issues with their porches, including bulging, intense internal failure, and separation, yet Traton Homes refuses to help, even though they knew of the product failure long before most of our homes were out of warranty. The representative that came to my home did not fully inspect the porch, saying that the damage was not that serious, even though the railing is completely broken away, the columns are bulged in several places, and there are holes in the material large enough to put your fist through. I do not want to hear that they aren't making the money that they used to, as their representative told me on the phone. That is not my concern. My concern is that a major builder in the Atlanta area used a faulty product and is now refusing to stand behind their work, their name, and the products that they used and sold to unknowing customers for whom their home is their greatest asset. Traton Homes is still very actively building in the northwest Atlanta area, and I expect that if they truly consider themselves to be a reputable builder, that they will send one of their many crews to my home and repair the damage that their choices caused. It is the only responsible and correct thing to do. My home has already lost much of it's value, and now it is falling apart. If they are not willing to repair the damages their choices caused, they should not still be in the home building business.

I just bought a home from Traton Homes. I got a landfill in my back yard. Traton says not their problem. It cost me
$5000 to remove trash. Traton would not split the cost with me. Not their problem they said.

I just closed on a Traton Home. I wanted to put a pool in. I found a landfill in my yard. Traton said they did not know about it. Well I did not know about it either. I have to pay $5000 to remove the debris. I asked Traton if they would go half with me. they said No you bought the house its your problem.
