it amazes me how a system can be put in place to protect children and in the process the parent can be treated like a criminal even though there is stone proof that the department is breaking the law in there procedures and nothing is done about it by the legal system as parents you have no rights to your children.

Withholding Information and Fabrication is what to expect nothing less! My little one is in custady right now due to such alligations not only does the CPS staff withhold information but the same goes for some of the officers that go on the calls with the worker. The american people can only do one thing record while they are in your house that is the only way you might win in court cause the judge will always side with the states testamony when it comes to hear say and two state workers against you waighs more on perponderance of evidence. So kidnapping by color of law is excepted and allowed! If caught nothing will happen to the worker she will simple be transpanted to another state and then there is no registry you can check to see if she has done it before! There is to much money from the federal government to be made. To find how this is done go to fight cps arount the nation or go to youtube and check out cps corruption news stories with a state that borders our own, out of ky. So far they have been the only brave ones out there to air stories about the legal kidnapping and have even got so lucky as to have ex and former cps social workers let people know on how its being done, in states. Senitor Nancy Schaefer has a legislative letter from her desk about this she exposed the corruption nationwide back in 2006 and still hear we stand in 09 with the same problems. There is a Documentary on CPS Corruption its Called "The Protectors" you can see the traylor on you tube I suggest everyone wake up and check this one out now as well as fight cps because you never know when someone can repot you if they're mad at you. Many people just dont know how to be assertive and calling CPS is how they resolve conflict but even if you proove the alligations wrong hear in TN if the workers numbers are down you could be the next one to loose your child. People from Tn need to wake up, for the Osbudmans office will not help you neither will the CPS commishioner for they all back up each other in making sure the money keeps rollen in. The only coveredge you will see is if the child is in Foster care and has been close to death etc . Never does or has a story run on parrents having the childen stollen or legally kidnapped from falce alligations, or withhholding evidence. Thanks God for Ky WLKY Channel 32 they found 8 roge social workers in that state alone. Lets face it folks it takes media backing to expose this corruption! Responsable citizens of all walks of life need to make a stand and fight for the rights of families and children to stay together and for CPS reform hear in TN! Gov. Bredesen dont worry your workers are diligently worker hard for your federal funding dollers to flo into your state! Of cource at the cost of seperating families from their children due to falce aligations. And sir for when there is no accountability for such actions I am sure your $73 millions dollers in federal funding will find its way back in your beloved state! God have murcey on our children and right of parrents hear in TN~!

Not only does DCS, in most states, fail to properly investigate and remove children but they are becoming more diligent about removing children in perfectly fine homes. Why the push? Money! They get thousands of dollars for children they can adopt out and who easier to adopt than un-damaged children. Instead of doing their job to help children, they have become a business.

Dee,

I see you are from Covington, Tennessee. That is in Tipton County I believe. West Tennessee has perhaps the most corrupt CPS service in Tennessee. Tipton and Lauderdale have horrible agencies. Stand up to them and fight if you are innocent and never trust the case managers. They will secretly encourage the other parent to sue for custody, etc and then claim they never said it. DCS is useless, hang in there.

Does anyone think that the Tennessee Department of Children's Services will play any part in the gubernatorial campaign this year?
We continue to read of atrocity after atrocity in the local media where DCS has failed to protect the children of our state. One of the most recent cases reported in the Tennessean on 9/7/06, "DCS failed another child" ( http://www.tennessean.com/apps/pbcs.dll/artic... ) involved a 5 year old boy named Carlyle Mullins who died and even DCS says the caseworker was at fault. Yet, even with her failures that resulted in the loss of an innocent life, she was merely transferred to another position within the department. Her actions as a CPS worker, at a minimum, constitute negligence, if not gross negligence. And, the latter is an offense worthy of nothing less than termination, if not prosecution. And, many sure remember little Haley Spicer that suffered at the hands of CPS's ineptness.
But, the CPS division is far from the only problem with Viola Miller's department. In the field, the Courts are becoming increasingly frustrated with the department's inept ability to provide for proper placement of juveniles. Delinquent juveniles are placed in non-secure locations. When the continually runaway or escape, they get returned to similar placements. Delinquent juveniles with known escape/runaway histories have been put in non-secure locations by the Placement Division, even when field workers have cautioned against it. And, for noting their caution, they get threatened with disciplinary action, if they do not comply. When someone tried to look out for the Tennessee public, they are threatened with disciplinary action.
Dr. Viola P. Miller's (DCS Commissioner) background is one of social work. And, that is evidenced in her approach to dealing with youth, even on the delinquent side. The big DCS push, with Viola Miller at the helm, is to treat all juveniles as social services cases. Theory being that they are all products of their environments.
That may be true in some respects. But, there is a difference between a child in need of social services and a delinquent juvenile. The latter has committed a crime, not just been truant, unruly or substantiated on some status offense (i.e. only a crime because they are under 18 yoa). A delinquent offense is something that would otherwise be considered criminal were it committed by an adult.
Some say that we need more legislative oversight. But, we have had a Select Committee on Children & Youth with representatives from the Tennessee House of Representatives and the Senate for decades now that are supposed to monitor DCS and other efforts involving children. And, many of these elected legislators have been on this same committee for many years. There is not much new blood to give a new set of eyes to look at the issues at hand.
Issues sent to the governor's office are forwarded to Dr. Viola P. Miller, the Commissioner of DCS. That is like asking the fox to watch the hen house, to ask her to review complaints against her department and her.
Some legislators have called for the knee-jerk reaction of abolishing DCS and rebuilding from the ground up. But, that isn't feasible. But, a major restructuring of efforts dealing our state's youth could and should take place, post haste.
So, what do we do. I am only one voice. Has anyone out there written their state senator or representative to voice concerns about the issues with DCS? Have you heard anything back? Usually, I don't get a response or I get what seems to be a canned statement that is copied and pasted into an e-mail back to me.

I think the wrong person is being punished here. In my case the mother and the school should be locked up for letting it go this far. So stop putting blame on the kids but where it belongs!

they need to concentrate on real cases and stop intervening in every house that a parent is caught smoking dope. maybe help these people but don't take the kids out for years at a time, which is the way it ends up and which costs taxpayers enormous amounts of money. time and money could be spent on the cases where abuse is more severe.
on the other hand, i think that is the objective. there are so many private providers that make a little here and there on each one of their social services provided and most all are ultimately owned by a crony of the governor. so you get the picture.
I agree dcs and the gov need to rethink the program

The biggest problem is the head of dcs and gov does not even know what the social workers are doing! If the would take the time and investigate some of the cases a lot of social workers would be fired!!

That's because your a busybody and instead of reporting her to DCF maybe she needed a helping hand. Something you didn't offer her did you. You sounded upset at her not being arrested. I sure wouldn't want you to be in my family. BEWARE... You sound pathetic at saying that "she wasn't even arrested"... I am a grandparent. And at times, my daughters would like a little break from motherhood. I am happy to have the little tykes around, they are family. Family should constitute love, and intervention when help is needed, even for the smallest break needed. There are moms out there that go through post partum depression, and kill their children because they become overwhelmed at times, but nobody saw the signs or offered any help...Sad, very sad. Where are the real families at today?

i have dealt with this system first hand and is jacked up. the people who try to do their job have people over them who just want a pay check and don't care.i have a family member that would leave her babies at home alone, i told the worker, she got arrested for child abuse the worker kept the police from taking her to jail. when we went to court the advocate tried to help keep the children from returning home but the DCS worker fixed it so that the children were returned. of course, now she won't let me see the childern, all i can do is pray that i don't see on the news where she have done something even more tragic

Well folks this has been some interesting reading...here's another D.C.S. saga for you.
My adopted teenage grandson got mad one day over a school paper and pushed me to the floor injuring me. D.C.S. stepped in and he ended up in a foster home. Now 5 months later I am made to jump through the D.C.S. hoops while he is given the red carpet "poor child" treatment and I am wondering what does that tell the "poor child" [that it is okay to abuse someone and that you are rewarded for that abuse???] With this kind of example what will I be faced with when (or if) he comes home?
And there is more.........
While in an unsupervised foster home with other teenage boys, my grandson was burned and tortured by some of these boys. No charges were filed. I wrote to D.C.S. Commissioner (Viola P. Miller). She never replied, but suddenly I get a letter saying I am found guilty of putting my grandson at severe physical risk! Go figure that one? There is much more to this story as you can imagine........reprisals from D.C.S. are expected....but keep the faith - with enough media publicity, letters to Govenor, Congressmen, Sentors, Representatives, District Attorney General, etc. the door will be open and all will be revealed!
Any comments or suggestions are welcome!!
Let's all work to revamp the D.C.S. system and get some "common sense" in there to help our children..........
The gov dept is no help they will only hurt you more!

My daughter now 22 has given my family major trouble since she was 13 years old. Reaching out for help i used DCS being told that was the only source well all that did was teach her how to work the system and make our family life very miserable. She has been very abusive to everyone in the family physically and emotionally and does not care who she hurts as long as she gets what she wants. She was pregnant before she aged out of state custody because she had more freedom in their custody than our home, then when my grandson came along she wanted back into the family. Even though when my mother was murdered she sent me a letter by her case worker that she hated my guts and wanted me to sign my rights away as her mother so she could live her life as she wanted. I have two children that was raised in the same home with the same values my other daughter is as different as day light and night from this one. However, when Kameron came along we aloud her back and tried to forget the past, but whenever we could not give her what she wanted or disagreed with the way she was treating the baby she would go off on us again. Now she lives with a police officer that she claims has a problem with color, my grandson is biracial, i have practically raised him the past 4 and half years now because of some pretty bad bruises on him that i questioned, she wont allow me to see him. He told me that the boyfreind was spanking him with a paddle come to find out it is a paddle like you see in schools. This child is only 4 years old. DCS was called in and according to my daughter the worker told them that it was going to be an open and shut case but they had to make a visit because 2 reports were made. DCS never contacted me, but supposedly told my daughter there was nothing wrong with paddling him as long as there was no marks left. Some case worker huh!!! I dont have alot of faith in dcs anyway, but what do you do? Plus my grandson has not been aloud to see his father in over a year because of the boyfriend not approving of blacks, he is having to go to court, but they dont have a problem spending the child support he pays every week.

i have a story about the other side of the coin.i was tricked into putting my child in pennusla hospital then she was going to a group home and i would have her home in 4 weeks.well when it came time to pick her up from the hospital they already knew they were taking her.when my husband said lets go we are getting an attorney they told me i could not leave or i would be arrrested for child neglect.and they said i had to sign her over to states custody, jennifer simposn's supervisor laura sane said i could have my childs paper work from the hospital they said no because jennifer said no.the charges on my child are truancy due to being sick, and i put an unruly charge which i plan on dropping.they being jennifer simpson and shelby akers said ig i drop the unruly charge i would go to jail for parent neglect.the guardian at lidum is not being objective she is just a bitch.and jennifer simpson told me another case she was working on.this other ladies case is she smokes pot with her kids and lets her have a 21 year old boyfriend stay there, the step dad is a drunk and crackhead.why are her kids not taken.they have been after my kids for 5 yrs and it pisses them off when all allegations are unfounded.my childs reasons for them keeping her in states custody has changed more times than i care to say.and i can't afford an attorney and the court appointed attorney can not represent me until i am served my court date is may 20th so you tell me how backwoods this crap is.

honestly it is exactly that a bunch of crap. the children who need real help often don't get it. then parents that need help with unruly children but don't have the money for fancy facilities, well if you turn to the state for help, you loose all your rights and your child typically turns out worse for they learn the system and get by with more where they are placed than they did in your home. The hardest part is deciding what is best for the whole family. My daughter was very abusive to my entire family both physically and emotionally and after several years of this and staying in and out of court with her it was not worth it, we didn't have the money to place her somewhere ourselves where we would have control, so we turned to the stated and that was a joke. But our home life became calmer. I don't know how disruptive your home life is so I can't tell you what to do. But dealing with the state is no picnic regardless of which side your on. My daughter is 22 now and has one son that will be 5 in July and pregnant with another baby and she is still rather violent at times and that concerns me, but I cannot control that, I use to question and blame myself, but we have another daughter that is as different as day and night and they both were raised the same. I did seek good counseling to help me through this tough time and learn that we can't blame ourselves, some people just make their own choices no matter what we try to teach them. I'm here for her when she needs me and love her dearly because she's my child, but I can't let her control me. good luck

I have a friend who is an attorney and we have had many "off the record" discussions about DCS. Let's just say I was told "DCS pretty much keeps us in business with their ineptness." The bottom line is you are going to have to hire a good attorney to fight and it is going to take a long time and cost a lot of money. DCS do not care and they do indeed target certain people. It has happened time and time again. Not sure if someone else has mentioned this or not but there are currently seven cases in the TN supreme court against them and there would be many more if people had the means. Filing a complaint against them does no good because they regulate themselves. Trust me on this. You will get a bunch of form letters etc and not a thing will be done. A lawsuit is what you have to do.

I feel for those of you who are victims of DCS's corruption. I have a friend who is a former social worker and she has told me a ton of stories about how they operate. There are a ton of great sites to help you. I would consider looking at http://fightcps.com , www.allencowing.com and I found a blog that basically verified what my friend has said at http://defeatdcs.blogspot.com

What does a monitor do exactly?
