R.I. court terminates illegal immigrant's custody rights

An illegal immigrant from Mexico who was deported after her 2005 conviction on child neglect and cruelty charges has permanently lost custody of her two young children, one of whom was born in Mexico, the other in Rhode Island.

Another Problem- EXPENSE- to USA Tax payers caused DIRECTLY because the USA Borders/Coast Lines are not secured, defended, protected, controlled allowing MILLIONS of Illegal Aliens to Illegally Enter the USA Yearly or NOT EXIT the USA when their VISA EXPIRES!!!!

IF THE ILLEGAL ALIENS WERE NOT IN THE USA ---THEN THIS WOULD NOT HAVE HAPPEN IN THE USA!!!!!

I get totally confused, entering the usa is illegal:but not a criminal offense...it is only an offense if deported and RE ENTER illegally again! Immigrants want their children to be BORN USA citizens:but want to take them BACK across the border if they are deported....so the illegal immigrants only want their children to have citizen status when it benifits them? I am upset(angry), at the park I hear a hispanic man (whom is here without papers) tell his children (whom are also caucasion & born in usa) what color is OUR country flag? The children pointed to OUR red, white, & blue flag, the dad then proceeded to tell them, NO YOU are MEXICAN, your flag is red, white & green! OK, if their country is Mexico, then take them back to Mexico & let your country support YOU & THEM, and if caucasion mom wants to go too, I'll buy her a ticket!

have tried reporting to ice "illegal immigrants": answer: what law have they broken?(duh..they crossed the border without inspection) can't help until they break a law, OK, I have an idea, let's put together a "FIESTA" buy big kegs of corona & XXX beer, invite every mexican you see......now also invite our local police to the FIESTA, say about 2 hours later. They will be ready to dance, scream, fight, leave drunk & no licenses....wow what a great way to party! Pretty blue lights

By what stretch of convoluted legal fiddle-faddle does a U.S. court have the authority to seize and retain the children of a foreign national, and to sever the parent/child relationship of foreign nationals. I don't get it at all. It is a very dangerous precedent. It is no longer safe to take your children with you on international travel. They could be seized, retained and your parental rights could be removed. See! It says so right here ...the U.S. did it, so can everyone else.

Departments of Child Services in the U.S. terminate custody for abuse and neglect all the time, and where ever you are, the laws of that country apply.

In this case the illegal alien mother allowed "horrific abuse" to be inflicted on the children.

Allowing the children to follow the parents would undoubtedly have condemned them to a life of further abuse.

It was a good call.

Entering the U.S. illegally is a Federal crime. Read for yourself:

Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:

Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or

Eludes examination or inspection by immigration officers; or

Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact;
has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Upon disposition the foreign nationals should have been remanded to their own country's social welfare system.

This is a very, very bad precedent inre international law.

I tend to agree with you regarding the child who is a Mexican citizen. But the younger child is American, and thus, the state in which she was born and resides has an obligation to protect her. The best way to do that is to terminate parental rights and allow her to be adopted.

This woman is not the first foreign national to lose custody of her American child, and she won't be the last. Illegal aliens can't have it both ways. Either they admit that we have jurisdiction over their American children, or they can refuse American citizenship for them and all the goodies that go with it.

Children born here to foreign nationals do not have automatic citizenship anymore. They DO have automatic legal residency, and can petition for citizenship on their 18th birthday. For certain nations, they may retain the citizenship of their parents despite birth here.
