can someone please tell me if a county judge can sentence a person to 12 to 24 months in a state prison for a first offence parole violation. The parolee was originally sentence to 4 to 8 months in the county jail. He served 4 months and was released on parole a year ago. He was caught furnishing false urine. His original crime was theft. No violence was ever involved. Please direct me where to find the laws on parole violations.

A Judge can do whatever they please, up to and including violating a persons rights.

Rules are normally if a condition of parole is violated then the person can be confined for the remaining balance of the time of their original crime. Hence, if the person you are referring to was sentenced to 1 year, served 6 months then violated parole, the remaining 6 months could be served. Unless there is something your not telling, there really should be no reason to imposed a longer than original confinement.

I suggest you obtain legal counsel, either private lawyer or Public Defender. It is possible that besides violating his parole he may have violated the law by offering a false urine sample.

He wont be sentenced to a state prison,but if that was his first violation its called a (tec) whatever his orginal probation was a judge can sentence him to a couple moths in county jail not state prison. Unless you are lieing and he was paroled from a state prison. Probation offcier will recommend how many months he can get to the judge for his first tec. Its other alternatives like,house arrest,longer probation,intermidet punishment. I dont see him doing state time for his first tec if he was paroled from a county jail for such a lil petty theft. He will be alright.

The reason why is he was sentenced to 4-8months, then violated his probation. thus creating a new charge. His new charge mandated he serve the exsisting charges max sentence and his new charge gave him 1-2yrs + the old charge. When you receive 24+months you automatically mandated to a state prison system. They wil serve a few months in the county than be shipped out. With good behavior, that person can be out probably in 16months. Question is I would get a lawyer of some sorts or appeal the decision or sentence.

Probation dept. is a complete joke. Biggest bunch of losers in the county, even worse than the sherrifs dept who ONLY want to transport prisoners not actually do any police work. Thats a fact.
Sounds like theres more to this story than is being told. He should have received 3 months jail time for the urine violation, period. There urine test are flawed, if he has a dirty test make them send it out to be retested, very good chance it will be clean. Another fact.
Anyone whose never been tangled up in franklin counties crooked system go somewhere else and post cause you dont know how it really is.

Not nice to say ...BUT ..what did he/ she think was going to happen...
This person is not to smart ..Keeps breaking the rules...now he/she will come out
in a year or so and be a better person ..

Judges can do anything they want, esp. when they review their own appeals! Judges are the same as every other human, there are good, bad, corrupt, insane, evil, saintly, etc.
Sadly, there is little in place to stop bad ones from doing bad things.

I know some who has broken his probation more then enough times to fill out his fill sentence on young girls. He has been stealing, having young girls over his house he meets on line, driving his truck with a tag, can't use his license , plus leaves Pennsylvania goes to New Jersey , New York, has young people in is home all the time. Plus has stoling belongings in his home. Plus a lot more. See a parol office once a month downtown says she is a laugh. His name is nick viola lives on glen street , Philadelphia pa 19114 Zip. Booze drugs etc.

If a judge suspended two years and your paper said no jail time but 16 months probation and 10 months later you violate how much time will that person spend in jail..

My fiancee admitted to taking my prescription medicine for pain which is a non narcotic after testing positive for methamphetamine which is clearly a false positive will the judge condemn her to jail even once the urine comes back from the lab as negative for methamphetamine?

Usually they slap her wrists for a first time dirty urine, but if she had prior write ups than she just might get violated.

It total depends on which county, which judge she ends up before, what the probation officer recommends, and what it was for. In Lancaster County, 30-45 days if there are no new charges is normal, but there's one particular judge that if it heroin, it will be 6 months plus.

My husband went to jail and our po told us he was going upstate he only tested dirty no other charges. I'm lost on what is going on I get put in jail a fine and house arrest for defending myself if its just a dirty test or home plan situation will he go upstate? Please help our kids miss there daddy

Well I live in a franklin county area and my husband went for a dirty test our po told us he was going upstate for it his charges r like burglaries and stuff like that he didn't catch any new charges but the officer was been trying to get us to split for a while now we went got married even tho he said no the judge lifted the no contact but he stay telling us different things I have no idea of what's going on
