What in the world is this Judge thinking?

BROKEN BOW - A McCurtain County judge granted custody of a child to the 45-year-old father, even though the child was conceived as a result of second-degree rape.

Not only that! The judge orders the mother, a victim of rape, to pay child support! And there is more.

Giving children to a pedophile to raise and rape is typical in Oklahoma.

The children were born because the pedophile molested and impregnated a child, does add a new twist.

And who says there's nothing wrong in Oklahoma?

I must say that it is not typical in Oklahoma to give children over to pedophiles to raise and rape. I was raised in Oklahoma and I take offense to that statement. I could say the same thing about any state in the union. This has happened here in Maryland, and I am pretty sure it has happened in Texas as well.

I think that it is obvious that the "judge" wasn't thinking. Was he appointed, by the governor or elected by the people, to the bench?

I believe assosiate district judges are elected to 4 year terms. I do not know when his term is up but I am trying to find out. Laurie is right. It happenes everywhere. This is close to home for me. I live in adjoining LeFlore County. I know the tag under my name says Kansas. I do not know why.

Judge DeBerry is running unopposed for re election to a 4 year term this November. However, the DA who has refused to file rape charges against Tucker has 3 opponents in the July 25 Primary.

UPDATE:

Melonie Knutson and Keith Tucker are scheduled to appear in court in Lake County Mississippi where Tucker has filed for custody of Melonie's 4 year old daughter. Hopefully the Judge in Mississippi has more brains than the Judge in McCurtain County, Oklahoma. This cannot happen folks!

Hello Anna. First of all, I am in LeFlore County Oklahoma, right next door to McCurtain County. Just about every time I post the tag under my name shows a different location. I have Alltel dsl, I think that is why.

Oh, sweetheart. My heart breaks for your friend. I do not understand where you need me to go to comment, but I surely will if you can post a url.

We have an even more horrific thing happening right here in LeFlore County. A 14 year old girl has come forward and said her father, her own natural daddy, has been molesting her since she was 7 years old. The daddy has admitted it and said the kid started it. He has not been to court yet.

Dirty old men are safe everywhere it seems.

I think they should take away this judges license, send the father of the chilgd to jail where he belongs and his cell mate should be the judge!

The district attorney who failed to charge Tucker for the rape has failed all of us in Oklahoma. What does it say to those girls who have been raped about coming forward. This DA is a woman, and I hope she is replaced in the upcoming election in McCurtain County. How could anyone not charge an admitted rapist for a crime?

I posted earlier that this young mother is going to have to face her rapist in a Lake County Mississipi court on August 23 where he has filed for custody of the 4 year old daughter. Correction:

That is Leake County Mississippi.

Virginia Sanders is the District Attorney in District 17 which includes Choctaw, McCurtain and Pushmataha Counties in Oklahoma. Sanders is currently running for re-election. Here is her Formal Statement( http://www.mccurtaincountyview.com/election/s... ) regarding her candidacy and outlining her standards, goals and positions.

In spite of her claims to the contrary, Sanders is arguably in the opinion of this writer a child rapist's best friend.

Sanders claims:

"I have prosecuted all types of cases including murders, rape, child abuse, and multiple felony property crimes.

And

I prioritize prosecution of drug cases, especially methamphetamines; the prosecution of violent crimes, and the protection of our children and our elderly."

However the fact remains that Sanders has thus far refused to prosecute admitted child rapist John Keith Tucker.

Tucker is a child rapist that proclaimed in open court and under oath that he did in fact rape a child, impregnating her TWICE between the times the child was 14 and 16 years old. Tucker is an admitted child rapist that has the audacity to sue for custody of the children born of rape and who in McCurtain County, Oklahoma was awarded custody of one of the children and this is spite of the fact that the judge ruled that Tucker was in fact a child rapist!

In a Bubbaworld special report titled McCurtain County Madness we covered this scandal which has taken place on the watch of District Attorney Virginia Sanders. Sanders may well be the only District Attorney in Oklahoma history that has refused to prosecute an admitted child rapist.

What about John Keith Tucker makes him above the law, immune to prosecution and what connection if any exists between him and Virginia Sanders?

With Virginia Sanders coddling and protecting an admitted child rapist, is any child safe in the 17th Judicial District? What if another child catches Tucker's eye and he again turns into a raping monster? Would Virginia Sanders prosecute him then, or would she give him another walk?

The statute of limitations for Tucker's horrible crimes have NOT expired. However, if Virginia Sanders is re-elected District Attorney they will have expired within her next term in office. Is that a chance the voters of District 17 wish to take? And with their own children?

These are questions and issues that voters in Choctaw, McCurtain and Pushmataha counties should have on their minds when they go to the polls to vote on July 25th.

Did any of you attacking the judge and prosecuter attend the trial? Or read the transcript?
The judge's decision while unorthodox is made NOT to say "it's OK to do this!" but, rather, in the interest of what's best for the child. This is not a case of a stranger rapist showing up out of nowhere, these people lived together and had a long-time relationship (she claims not at her will, he says otherwise, regardless when one's 14 it's illegal and wrong) and the child's known his father the whole time.
The prosecution's even more cut and dried, this is quite likely the right decision. We'd all love to see this guy get 30 years, in a purely emotional way I would too. But you gotta remember that this is a nation of LAWS, and the law doesn't say "if you think someone did something bad, even if it was a long time ago, you can just lock them up." Chances are VERY good that if they did bring this guy up on charges they'd not be able to get a conviction, if they did it's highly unlikely this guy would get more than an extremely minimal jail sentence. Meantime huge amounts of money will be spent and worst of all the effects would be devestating on these kids, and nothing of great value will have been accomplished. There's no record here of a criminal record for the father, and it seems safe to assume that if he had a record of child abuse, it would be known. A person who is a legitimate pedophile and child molester doesn't just do it once, then wait 18 years, then do it again. IF I'm reading this correctly that the guy's not a convicted molester, there's not much reason a judge can think he's a significant threat to these kids.
Both the judge and the prosecutor knew this case would get a lot of attention and that their decisions would cause a massive uproar and might well, eventually, cost them their careers. They could very easily have called for a circus trial and tried to look tough and had everyone at the diner pat them on the back...and really not done a blessed thing to make these kids' lives better, or anyone else's. This nation's great because we are a nation of laws, that apply equally to everyone, and because we have people who are brave enough to do what is right even when it's not popular.
