The U.S. Attorney General, Eric Holder is doing an inquiry on Sheriff Joe Arpaio for charges of abuse-of-power in Phoenix. Hopefully they will take a look at the abuse-of-power by the DA's office and take the appropriate action.

Please refresh all of us on just what led to your last encounter with law as I believe it help contextualize your posts.

If I recall correctly it was something to do with sex and children, is this correct?

as for my knowledge...actually a math major with a double minor in physics and computer science. studied some law on the side. when i started college i wasn't too sure which direction i wanted to go - law, business administration, or teaching. so as time went i made sure the classes i took qualified or would credit all 3 majors and ended up with applied mathematics with the law and teaching courses as electives.
my last IQ score was 185.
as for being a whistleblower - wish i could. these people are dangerous. they can charge you with a phantom crime and tie you up in court for god knows how long then if they have had their fill they dismiss the case citing "little or no evidence" - then you can't sue the prosecutors because they have immunity. plus they delay the trial so that the statute of limitations runs out and you can't sue anyone. it's all a scam and the taxpayers fund every step. so you and i are supporting their criminal activity.

mr. daniels is charged with aggravated stalking for attending an athletic event. yet in the grand jury he's alleged to have gone to a multitude of events ones specifically named that never occurred. then supposedly he sent a multitude of text messages and yet no one's phone record shows these phantom transactions. worse the allege that he used the girls friends to forward text messages...if that were even close to true then that makes the girls friends third party contact and accomplices and/or accessories to the crime charged.

i truly don't know where you got sex from. no one has made any such comment nor is there any charge or any reference whatsoever in any court record. thankfully you did start your question off with "if" so i can't fault you for that, but you have recalled wrong.

i have no problem with the law. i studied law. got friends that are police officers, deputies, lawyers, judges, but they're all in el paso and they all think susana martinez is crazy. but it's not their jurisdiction. texas - new mexico. two seperate states. in texas the district attorney is not allowed to make a personal, albeit, threatening phone call to an accused. yet in new mexico susana martinez called mr. daniels on a cell phone and threatened him. it's even listed in the criminal complaint which is why she cannot deny it.

but she is good at lying to people. very good. not me though i spotted her skankness from a mile away. plus she had some ten foot pole marks on her...

here's a thought...

my friend is charged with a fabricated crime. he is being held to a criminal charge and is limited to the many things any non-charged person can do. he has lost his liberty somewhat.

this loss was due to a group of people who schemed a plan to rob him of his freedom. they definitely hope to incarcerate him and have deceived the court and the jurors with a plethora of lies.

he has complained to no end that these people have lied and yet the court's answer to him is "if you are unhappy with your attorney you can hire one."

on average the attorneys are charging $30,000.

so to be FREE to regain his LIBERTY he has to pay $30,000

i'm sorry but that's extortion and to some degree aggravated kidnapping for he has been detained and in order to be set free he has to pay a ransom.

so the dona ana prosecutors can charge you with anything at-will. coerce people's testimony and you have to answer to a false charge. your life gets placed in turmoil and the only way you can possibly end it is if you buy into their game. you have to pay. you have no other option. they don't care if they break the law. the laws don't matter to them nor do they apply to them. if you want freedom you have to pay for it.

freedom has never been free.

I personally know that Susanna and her office are very powerful. They will ostricize a police officer for doing his job when they dont work with her plans. Thats right, her office will dopr charges on people if its to their advantage then screw over cops when they chose not to play along. Not to mention it helps that her husband is the undersheriff of the Dona Ana County Sheriffs Dept. Its a very screwed up situation. And if you wondering why people dont complain its because they will get fired, ask her long list of attorneys that have been dismissed, or talk to local police officers about their feeling about her and you would be amazed.

My question is if the DA, who is supposedly aggressive,tough on crime, anti-corruption, reform and the rest of the plank-shit bs, this alleged crime occured on 4-07-2007. If this alleged defendant is such a monster, why in the hell isn't he locked up away from the young woman. This case smells worse than driving into LC at night from the west.

correction. i have posted here or elsewhere that there were 8 or 9 police reports. reason being that they claim in the grand jury that mr. daniels had attended ALL of the alleged victim's athletic events and that the parents filed a police report for every event. well i was wrong, there are 6 police reports and here is a summary.

Report 1 - April 2007 - response on the day of his suspension. a regular school day, no athletic event. the officer tells the administrator no crime has occurred.

Report 2 - May 2007 - follow up to report one. no athletic event. officer asks the alleged victim if anything had happened. she responds no and the officer tells the mother no crime has occurred.

Report 3 - June 2007 - follow up, no athletic event called for harrassment, but the officer closes the report with no investigation.

Report 4 - June 2008 - NMSU womens bassketball team camp. open to the general public. NMSU police demand that mr. daniels to leave the campus, given no clear reason, and no detail to what he actually did on campus to justify the demand to leave. mr. daniels complied.

Report 5 - August 2008 - mr. daniels transported his club players to a volleyball scrimmage. the alleged victims parents told the deputy he was trespassing, but the deputy stated there was no trespass warning for mr. daniels and he was free to stay on campus. but asked that they stay away from each other. mr. daniels complied.

Report 6 - October 2008 - mr. daniels attended a volleyball game. No officers or deputies arrived on scene nor was any call made. this report was filed two weeks after the fact and is filled with inaccuracies. one stating that mr. daniels provoked the alleged victim's father, but the report does not contain the identites of the parties with mr. daniels to confirm he did not provoke the father.

a total of 6 reports and yet we're to believe they filed a report for EVERY game. only 3 contain athletic events. a team camp, a scrimmage, and an actual game. so if all they have is one actual game no wonder their record is so bad. 6 reports and only 2 have any comments from mr. daniels. 6 reports and only the last one contains gross inaccuracies. 6 reports and yet NOT one contains any language to support the charge of stalking. no threatening conduct or behavior. nothing.

6 reports and NOT one of them supports any statements made by anyone during the grand jury nor the superseding grand jury.

it's called fraud. susana martinez has perpetrated a fraud and definitely has a strong hand in a conspiracy to deprive mr. daniels of his rights secured by the United States Constitution.

It seems the smaller the community across the country the more abuse-of-power there is with these little minions with a title and some authority. Thank god for the internet to expose the crimes of this office and hopefully one day they will be investigated and dealt with accordingly.

From your summary it sounds like the police are not doing proper or complete investigation of each incident.
Mr. Daniels was indicted by the grand jury.
The grand jury is not exactly a kangaroo court!
Why is it Susana Martinez's fault that a grand jury indicted Mr. Daniels. That would indicate that Ms. Martinez did indeed choose the correct course of action with respect to Mr. Daniels actions.

They never said it was the DA's fault that the gj indicted Mr. Daniels. If the police officers reports were not done properly or incomplete, then why didn't the DA drop the case. The original charge was on 04-30-07!! Damage control by a kangaroo comment, give it a rest pal.

Err... The thread is titled "Susana Martinez Real Agenda".
I think if you read previous posts they indicate that Ms. Martinez is the one to blame. This is not damage control, it's id1ot wrangling and you just got wrangled.
There must be merit to the case or it would have been dropped.
If you insist that corruption is rampant in the DA and you want something done take it to the FEDs. If you think there is rampant corruption in the DA and you want to look like a fool, take it to Topix on the Sun News forums.

susana martinez is fully responsible when it is her duty to:

36-2-10.[Duties of attorneys.]
It is the duty of an attorney-at-law:
A. to support the constitution and the laws of the United States and of this state
C. to counsel or maintain no other action, proceeding or defense than those which appear to him legal and just
D. to employ for the purpose of maintaining causes confided to him such means only as are consistent with truth, and never to seek to mislead the judges by any artifice or false statement of fact or law
G. not to encourage either the commencement or continuation of an action or proceeding from any corrupt motive of passion or interest

she has a professional responsibility to:

16-303. Candor toward the tribunal.
A. Duties. A lawyer shall not knowingly:
(1) make a false statement of fact or law to a tribunal or fail to correct a false statement of material fact or law previously made to the tribunal by the lawyer
(3) offer evidence that the lawyer knows to be false; if a lawyer, the lawyer's client or a witness called by the lawyer has offered material evidence and the lawyer comes to know of its falsity, the lawyer shall take reasonable remedial measures, including, if necessary, disclosure to the tribunal

the committee commentary adds:

if you were in the grand jury and you heard from a police officer who was sworn to tell the truth say that mr. daniels violateda restraining order. you hear from the alleged victim's mother that he attended "every" game what would you decide?

what then will you say to the fact that no restraining order ever existed nor did he attend "every" game? that is perjury on their part and susana martinez as an attorney-at-law is FORBIDDEN from letting her "clients" commit perjury. because that action is permitting a party to commit fraud by deceiving the court.

now you can believe that she is some champion for justice or that she is learned in the law, but this one transaction surely brings into question everything that she has done. so yes you go right ahead and side with a criminal. i'd rather side with the truth.

you might want to get on the internet and see that this has happened to other people. not just with her or even in new mexico, but new mexico is a great state. for it was in new mexico that a woman got a restraining order on david letterman. the judge rubber-stamped the complaint didn't even read it.

the duke lacrosse case.

michael nifong purposefully chose to destroy some people and when he was judged wrong what was his punishment - a 24 hour detention.

worse they can't sue him for his wrongs. prosecutors are absolutely immune. even state officials. in new mexico at nmsu a professor lured a student raped her and tried to kill her. she survived. while he did get incarcerated she tried to sue him for damages, physical and emotional damages, but the state ruled him immune from civil prosecution because he was a public official.

prosecutors get away with their criminal activity because the legislators have made laws to protect them. imbler v. pachtman says that if everyone could sue prosecutors then that would hamper their work. that less lawyers would want to be prosecutors. so they aren't liable for anything they do and only ONE person in new mexico makes note of that. Judge Ira Robinson in their dissent:

"Where these same officials misuse the machinery of government and do so maliciously, they shatter the public trust and injure those who they are sworn to protect. The majority believes the legislature has resolved the conflict presented in this case in favor of granting public officials broad latitude to proceed without fear of lawsuits. I suspect that is why public officials do wrong because they have no such fear."

now is a great time for the people of new mexico and this country to demand that prosecutors be held just as liable as any common person. they are not above the law especially when they choose to break it.
