He was probably just doing his job. I don't see how the university is responsible. OSHA doesn't require fall protection of platforms under 4 ft.

Hey guest, since when is it part of a persons job description to ignore common sense; were not in the early 1900's where you risk getting fired, we have retaliation protection etc... Wake up man. Show me one job in the US especially in the education realm that asks employees to omit safety. Also the 1926 OSHA fall protection clause you speak of is for tying off, that doesn't mean there shouldn't be hand rails, kick boards etc... If the university didn't have proper signage on the location he was standing than this moron is going to win, it's just another example of pathetic Americans doing their best to ruin America

If the man failed to use common sense, why is the university responsible for that?

As far as the OSHA regs go, they don't require hand rails or kick boards unless platforms are over 4 feet high.

Fall protection does no good under 15 feet because you're feet will hit the ground before a 6' lanyard with a 3' decelerator is fully deployed.

It's unfortunate that the man was injured, but the university bears no responsibility. His lawsuit will be tossed out because it has no merit.
