Winning Minnesota

There are 15 comments on the www.volokh.com story from Nov 8, 2012, titled Winning Minnesota. In it, www.volokh.com reports that:

Most of the post-election attention on the gay-marriage ballot fights has focused on the inspiring wins in Maine, Maryland, and Washington state, where same-sex marriages will now be legal. But equally important in the long-term is what happened in Minnesota on Tuesday.

Just as important, the Dems took back both the House & Senate in Minnesota.

So now that the amendment has been defeated, there is nothing to prevent the new Dem-majority legislature from passing a marriage equality bill, which the Gov has already said he would sign.

I doubt they'll move on this in 2013- they don't want to make the same mistake the GOP legislature did; but I can definitely see it happening in 2014 before next election.

So, you see them timing it so there won't be time for the opposition to get it on a re-election ballot? It would have to be so well prep'd that it would sail through committees, etc.

Wasn't the existing Statute a State measure? CAN it be repealed solely by the Minn Legislature?

I meant they likely won't focus on marriage the first year. The GOP got in trouble because in '10 they campaigned on "jobs, jobs, jobs", but one of the first things they did was pass the constitutional marriage ban.

So I see the Dems focusing on fiscal issues the first year, and THEN they'll likely pass a marriage bill in 2014 before the Governor is up for reelection.

Their current ban is just a statute passed in 1997 by the legislature; it can be repealed by a new bill by the current legislature.

Good to know. As recently as '97? really?

Yep. There was no actual legislative ban before that. The Baker v Nelson decision was based on the assumption their marriage law meant one man one woman. In 1997 they pased their version of a DOMA law just for extra measure I guess.

I remember reading something (may have been around then) knocking around the halls of Georgetown, Regis and ND sometime in the mid-'90s using the phrase "redefine marriage". I was so busy with some other things that I didn't pay it much mind. I certainly didn't connect it to the Marriage Equality fight at the time. I started to notice the catchphrase popping up in other locales, fundie sources mostly, around '99. About the time "That's so gay!" showed full saturation on Mormon teen chat and gaming sites, and began aggressively appearing in the general online teen parlance.
