"The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts. One's right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections."

AMENDMENT XIV
SECTION 1.
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Indian already has a ban on SSM. Passing a Constitutional Amendment will only hurt the State in the long run.

Incidently, the ban also makes it a crime for a minister from a denomination that DOES offer SSM is barred from practicing his religious beliefs. Any member of the clergy who presides over a SS Union faces 180 days in jail and a fine of $1000.

Yet none of the anti-gay people screaming about their religious freedom seem to have NO problem locking up ministers, rabbis and priests.
