TRUE BELIEVER: One year after a jury convicted Scott Dyleski of killing his Lafayette neighbor, some people believe he is innocent.

Barbara Weaver, a 44-year-old surgical nurse who lives in Youngstown, Ohio, is one.

She didn't attend Dyleski's trial, but she has developed a Web site, http://www.justiceforscottdyleski.com , that tries to poke holes in the evidence used against the teenager.
"I saw a lot of problems with the case," Weaver told the Eye by phone last week.

She originally saw the stories about Vitale's death on television, and she became passionate about the case. Court cases interest her -- she followed Scott Peterson's closely -- and said her instincts told her that Dyleski was innocent.

"It was mostly because he looked like such an unlikely suspect in my eyes, his age and the nature of the murder," she said. "I thought to myself that they must have some really hard evidence against him."

A jury found Dyleski, then 17, guilty of murdering Pamela Vitale on Oct. 15, 2005. Prosecutors said he did it in connection to a scheme to purchase marijuana-growing equipment with fraudulent credit cards and because Dyleski was under the mistaken belief that Vitale ran over his dog.

Weaver became a regular Internet message board user and met other people who also believed Dyleski was innocent, pointing out parts of the case that bolster that. She would follow up by looking at court transcripts, paying about $1,000 to acquire them to post on her site.

"I purchased things little by little," she explained, developing the site as a hobby.

Weaver's Web site features more than 20 topics relating to the case, ranging from what Weaver calls "lies" by the lead detective to the significance of hairs found on Vitale's body that were not Dyleski's.

She pointed to trial testimony that Dyleski told a friend he was concerned his DNA might be on Vitale's body because he had seen her taking a walk and she grabbed his arm.

"Who is to say that she didn't run into him?" Weaver said.

At the request of Dyleski's mother, she has set up an electronic donation system for Dyleski's defense investigator and has brought in about $7,000 so far.

"That's a drop in the bucket you need for the road to exoneration," Weaver said.

Daniel Horowitz is suspect. Look into the case. He filed a restraining order when he was married to his first wife Leslie, claiming his wife was in danger from their neighbors, the Schneiders. But they got divorced and soon after (?) he met Pamela Vitale. He filed a restraining order when married to Vitale, claiming his wife was in danger from their neighbor, Joseph Lynch. Vitale was murdered within a couple of months afterwards.

The trial was kept out of the media once Dyleski was arrested and thoroughly demonized - strange considering who's wife was killed. Horowitz was never treated as a suspect.

I don't understand how a defense atty/husband was never suspect.
The murder was filled with rage not fear of a teenager getting "caught in the act."
Think about it, Horowitz could easily frame some young, underprivileged kid who didn't exactly fit into mainstream society. Horowitz knows exactly how things work. DNA, evidence etc.. It's what he does for a living!
I hope this is not yet another case of a wrongly convicted child.

I hate to be the odd one out here. However, obviously you are all making your profound assumptions without knowing Daniel Horowitz personally and how very much in love he was with Valerie. I consider myself very priviledged and honored just to be acquainted with him. He is a fine honorable man.......

I hate to be the odd one out here. However, obviously you are all making your profound assumptions without knowing Daniel Horowitz personally and how very much in love he was with Pamela I consider myself very priviledged and honored just to be acquainted with him. He is a fine honorable man.......

I only found out about this whole case for the first time ever on Friday April 2, 2010. Since then I have been immersed into every detail and story about this case; reading every article over, and over, and over again. I didn't even know that Daniel had re-married until today, Tuesday April 6, 2010. Daniel has moved on, when I still haven't 20 years since a bad marriage of twelve years, and divorce. He is showing faith in Love for that!!! He has a son now, and understands how it would be for that Precious son to be falsely accused, and put in prison for life. I appeal to him here in this public forum; to continue to be the gentleman he most always has shown himself to be; and help us convict the true killer of Pamela, who I am quite certain is still at large!!! From all that I have read, I Believe that I have a Great idea who did this horrendous injustice to Pamela!!! Mark this day in 2010, for I have already started to pray for the truth to be brought to light; and the real truth Will be shown!!! The Person who did Murder Pamela will be found out; and will be found out quickly... Watch and See!!! And when you do see this come to pass, do not give credit to evil psychic powers; for they remain as nothing. For example, look at Susan Polk who claimed to have psychic powers... Yet she couldn't psychic see ahead of time; that she would not need to waste her time to defend herself, and that she would loose her case?!! Thank You for reading all of this!!!

I never thought they arrested the right person in the case of Daniel Horowitz's wife. I truly think in my heart that Daniel had something to do with it. I see him on Nancy Grace all the time & he always seems guilty to me. I can't put my finger on it. Even after the murder, it looked so superficial when he was on camera crying. It reminded me of Scott Peterson.
To find out that he married someone he had a relationship while married seems suspect. Being an attorney himself, he definitely would know how to plan & possibly get away with setting someone else up to blame.
I just don't believe his total innocence in this murder completely. He may not have committed it himself but I wonder if he had someone do it for him.
Just call it intuition on my part.

Bonnie, that's exactly how I feel about him. I've seen him on NG, with that sweet,smarmy attitude. Something tells me that LE needs to be more diligent with this case. My gut tells me he should have been named a suspect from the beginning. For all his grieving, his openly weeping on every tv show that would have him on, he didn't waste any time getting involved with another woman and marrying her. I don't like this man. Huge sleaze factor there.

Well, evidently, Horowitz already had Vitale lined up before he divorced Leslie Coffin per Wikipedia timeline and their divorce in March 1993. And, he had Valerie Northup lined up before Vitale was murdered.

Everytime I see Daniel it makes me sick. I know in my heart of hearts his hands are bloody. He is not innocent in this. Just saw tonight that he is married and has a brand new baby.What a sleaze ? He looked guilty then with those dry tears and he looks even more guilty now. Scum !

New habeas petition for Scott Dyleski at the link below. A lot of evidence available to the Contra Costa Sheriff Office/Lafayette Police Department and to Dyleski's public defenders was never presented in court or even investigated. There are several claims of Horowitz being abusive from people close to Pamela Vitale and of the couple having severe financial difficulties because of the building of the mansion and Horowitz pursuing his media career. Wow; you are still discussing this case?! I was never sure about Daniel either; and thought they went after Scott so quickly that it looked suspicious; like they just wanted to wrap up the case.

On the day Horowitz killed his wife transiting Pluto was conjunct his Sun, Neptune locked onto the dreadful Square from venus/saturn to moon/pluto forming a deadly T-Square.
Uranus in Pisces was conjunct his mars to the Minute!
Uranus conjunct his progressed sun forming an explosive deadly violent act.
With Sun so close to galactic center, horowitz has friends in high places.
