Obama urges Supreme Court to overturn California same-sex marriage ban

The justice department is supposed to defend the laws of the United States...it is not their decision as to what is unconstitutional or not...that is why we have the supreme court...

The Justice Department DOES NOT have to defend laws or Acts that they feel are UNCONSTITUTIONAL, plain and simple.......but it would have been better to give a bad defense in my opinion than not to defend at all because BLAG was formed, which by the way isn't representing ALL of Congress or even the House, but just 3 House Representatives!!!

Why? Congress lacked the authority to pass the DOMA that would make it constitutional.

You see, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." US Constitution, 10th Amendment

Can you indicate exactly where the US Constitution delegates the federal government the authority to regulate marriage? Absent such authority, the law is unconstitutional.

A swing and a miss. The Justice department can hold that a law is not constitutional and either choose not to defend it, or actively seek to have it repealed.

You've yet to offer a single place where the constitution delegates the federal congress the authority to regulate marriage that would prove the DOMA was constitutional. Absent such delegated power, the power is reserved by the states.

Read the 10th Amendment.
