The "issue" is not SSM. It is not "States Rights". The issue is can the Federal Government deny equal protection under the law.
Actually it is enumurated powers- the US congress does not have the power to regulate marriage that is a power delegated by the US constitution to the states.

actually, SCOTUS made a decision in loving v. viginia that thrust the federal gov. smack dab in the middle of marriage definition. that, coupled with DOMA, sets the precedence for the federal government making same sex marriage across the entire nation.

which, combined with the guarantees of the 14th amendment assuring all citizens the same protections and the supremecy clause of the constitution that states that all federal laws, federal treaties and scotus decisions shall trump state laws that don't coincide with those, kind of puts the states in a position of having to allow same sex marriage once scotus makes that decision in the cases being argued before it this month.

So you are in favor of DOMA? I am against it because it is an over reach by Congress. You are argueing in support of Congress doing it.

Problem is marriage is covered under Amendments 9 and 14 not just Amendment 10.

Excellent point. SCOTUS has ruled that marriage IS a Federal Issue on numerous occasions.

If it were NOT a Federal Constitutional Issue SCOTUS would not have the authority to rule on any of this.
