Clearly this Judge has never read the Constitution. If he had been familiar with it he would not need two weeks to know that Congress and by extension State legislatures are not authorized to pass laws against the peaceful associations between consenting adult individuals. This is an outrage that he has to wait two weeks. You either believe in freedom and liberty or you believe in subservience to the majority vote. It is the judges job to protect the minority from the whim of the majority. Why does he need two weeks to do his job?

It's called writing his findings. Unlike yourself he can't just cut and past from the writings of others. He has to do real research.

What research do you need to do to know that homosexuals have a right to gay marriage? Don't you already know? How do you like someone doing research and deciding if you can get married, or not? Actually Alan, I'm certain the Circuit Judge knows very well the Arkansas Constitution which he swore an oath to uphold and which clearly defines marriage as a union between one man and one woman.

Since you live in California, you have no right to tell us how to live here in Arkansas.

HOWEVER, the Judge does and if the State can NOT prove why marriage needs to remain STRICTLY between a man and a woman, KNOWN as a Compelling reason.......then the ban will be ruled UNCONSTITUTIONAL and you will NOT be a happy person.

A marriage contract as licensed, conferring thousands of government benefits is not like a date at a coffee shop, which would be a "peaceful association."

Doesn't ALL of these threads turn out the same way......they start out typically with a decent exchange, but inevitably someone likes to run it off to nasty comments......and it is obvious that some think they KNOW more about the Constitution of this Country than those who are sworn to protect it.

It's rather DISGUSTING that in Kentucky it's okay to screw the pooch, but NOT legal or okay for 2 CONSENTING adults over the age of 18 to marry!!!

That brought up a point I haven't ever thought of before, and it's probably because I just don't like to think about it. I have a special needs son, he had three strokes before the age of four. I make most of his medical decisions, his dad and I are married, I explain the problem to my husband, give him the options, and he says "whatever you think is best". If something were to happen to me, automatically my husband would become primary caregiver, make medical decisions on his behalf, etc. If we were a lesbian couple, that wouldn't be the case because we are Arkansasans.

Can someone explain to me why this is up to the states? I have never understood this! It looks to me to be against the United States Constitution, and that trumps states constitutions every time!

I can not do justice to your question, but as quickly as possible: the Constitution grants certain functions to the Federal government and does not allow Congress to do certain things which they reserve to the states. At the same time the States can not pass laws that the Constitution does not allow Congress to pass.

It is not a legitimate function of government to decide if anyone can get married. The government loves to make itself more powerful so it can have more control over all of us. Most people worship the government and have made it their God. They accept everything those parasitic con-artist criminal scumbags in Congress want to do.
