Family files lawsuit in metal bat injury case

The family of a boy who suffered brain damage after he was struck by a line drive off an aluminum baseball bat sued the bat's maker and others on Monday, saying they should have known it was dangerous.

The family's attorney, Ernest Fronzuto should be disbarred. The plaintiffs should be held in contempt for bringing the suit, and should have to pay the legal fee's of all the defendents.

Well, This is a very sad situation. Though, I do not see suing the maker of the bat. It was not the maker's fault that he was hit. Im sure the comnay did know what could happen, but those are the risks you take. There are everyday risks....

Accidents happen. When you participate in sporting activities, you're going to get hurt now and then. A few years ago, my son and I were shagging fly balls to each other. I lost one in the sun and caught it on the bridge of my nose. So, now, do I sue my son for throwing it, the ball company for making them so hard, or God for making the sun too bright?

This is why we need tort reform. Loser pays would stop a lot of these frivolous lawsuits. If you brought a law suit against someone and lost you just bought it!!!!!!!!!!

I'm not much of a fan of aluminum bats, but this lawsuit is an example of why America is falling behind in many areas. We want our kids to be perfectly safe at all times and have or take no risks ever. Baseball is a classic example in that fewer and fewer players that get to the majors are American born. Just a year ago, Mike Coolbaugh was killed after being hit in the head by a batted ball while coaching a minor league game. Last week, Frank Paino suffered a very serious head injury in a similar fashion while coaching third base. EVERYONE who plays baseball and knows ANYTHING about the game knows these simple risks. You can also go blind by being hit in the eye with a fastball, but that doesn't mean the ball is defective. This lawsuit might put this particular little league out of operation because of legal fees. That's just not fair to other children. Parents need to understand that there are risks to be assumed in living a full life. This lawsuit is plain wrong.

Also, I think the lawsuit is directed towards the wrong party. Sue the person who threw the bat, not the manufacturer!

Well I partly think that it was the bat-makers fault, He should have considered the damage the bat could inflict if it was made out of strong materaial like aluminium. Accidents do happen.

THIS is sooo TRUE!! and not just any little league, they will make it that way for EVERY one.. that is the way america works if ONE person is upset we ALL pay for it.. I know my 2 kids play and they dont have face guards and the father of the pither said he wouldnt allow his daughter to pitch if any of the players do not uses face guards.. which is not mandatory in little league but you watch it be that way now.. heck if they keep demanding things im going to have to either put the kids in bubble wrap head to toe or take a loan out for them to play..lol.. or WORSE not let them play.. what to do ???

Read the article you DORK and you will see that it was a line drive ball hit by an Aluminum bat...no one threw the bat, silly.
