Two additional days in jail for aggravated DWI? Typical NM.
So what if he thought he got hit by a flying rock. Fact is he drove drunk and killed someone. Somehow I don't think that is going to matter. Don't charge him with fleeing the scene then, but charge him with vehicular homicide. I don't have alot of hope. He'll be out partying Friday night.

If the jury can't decide or finds him not guilty, can't the DAs office retaliate against these jurors somehow? They ought to be charged with some kind of crime.

Ms. Stancy: Only if you sat through six days of testimony can you pass judgment on those jurors. They are conscientiously weighing the evidence so that they arrive at the right decision. If you were on trial you'd expect--but not deserve--the same treatment.

It's a shame that the shrill minority so often dominates the online dialogue.

As a mom I feel for the Tenario children and Fierro's child. These kids are innocent and will feel the impact of this horrible situation forever. Fierro's mother is probably saying to herself," I thought I raised him better than this." She still hurts for her son. For the Tenario children this must be a nightmare.Lives have been altered because of a drunk driver. Fierro was drunk, he admitted it. He drove that car anyway. The rock story was in my opinion a made up story and total BS... He knew he hit a someone. He sat on the curb and asked if they found the person that threw the rock at his car. He was already trying to create doubt for a future jury. If this man is convicted for nothing more than drunk driving I will be shocked and so will most the majority of people in Santa Fe.

as much as i hate to say this if he gets out of this so should scott owens. he & the state cop should be put in prison for a long time. i used to go to the bar and have have a few, but now i stay home. i could'nt live with myself if i killed someone for such a stupid reason. i din'nt see him thats bull. my own brother is a laywer & if he did something like this i would be sitting on the oppsite side of the courtroom. i'm sorry this is unacceptable. i'm drinking a beer right now , but you don't see me on the streets of santa fe right now drinking & driving. i don't care who he is , it should be the same for everybody. u kill u pay.

The reason they left the crime scene was to make up an alibi. A bought jury...maybe. Drinking and driving causes accidents. Fierro's bail was 250,000. Owens 2,000,000. That's where the parody begins. Owens will get hung, Fiero will walk. Tenorio's family can still take a civil case forward. Fierro will no longer practice law in NM. Udall and his band of crooks will take him to Washington. Public pressure can follow him...letters to every newspaper in Washington, to every DWI program, let his name be mudd.

Carlos Fierro & his attorneys are having delusions. They are hoping that the jury will let Mr. Fierro off easy on the basis that the William Tenorio, the victim in this trial, was the cause of the accident.
Give me a break! Do you suppose that Fierro's attorneys think that the jury is that gullible? Let justice be served to Mr. Fierro & to Mr. Lovato. They were both drunk, they killed an innocent pedestrian
& what's even more deplorable - they fled the scene of the crime.
Spare no mercy on the defendants.

The jury is taking this long cause it is examining the law that must be adhered too in convicting a person of vehicular homicide (the letter of the law is a son of a gun). When you have three attorneys, they present a masterful defense containing factors that a jury MUST consider prior to rendering a guilty verdict.
He will walk on the vehicular homicide charge because of the defenses' evidence, thats no secret (look at the evidence). Testimony which didnt match the physical evidence also hurt the prosecution in this one (video).... he WILL be convicted of DWI (self admitted) and thats about it.
Another case where the DA and police department is outdone by top notch legal counsel..........

It saddens me to see that this city and state could be in such bad shape that they have to re-think this case. This man is guilty. It looks to me like someone is wanting to let him walk. Such an unfairness is unbelievable. He is an attorney, he knew that by making that statement about the rock at the time he did, that it would bring doubt into someones mind about him telling the truth. He's trained to catch these things. I don't know anymore about Santa Fe. City of Faith is it not, well not anymore.

The New Mexican will probably delete this because they don't want to upset Ana Pacheco-the DA's sister who works there. That's why they delete negative comments about the DA-all in the family.

The public has completely lost sight about what this is about!

The DA presented an absolutely horrible case. She couldn't even get the step-down charge of Aggravated DWI right since his blood/breath result is over .16.

The problem is that the DA tried this case as a "simple" DWI with a death. This case is so much more than that.

She had to prove "causation" (BEYOND A REASONABLE DOUBT) in that she had to prove that Mr. Tenorio's death was a forseeable result of Fierro's actions and that Tenorio's actions did not significantly contribute to his own death. The DA failed in this regard.

One of many Examples: througout the trial and during closing arguments she comes out waving Tenorio's BLACK CLOTHES around in front of the jury. Are you kidding me???? In her stupid attempt to be dramatic, she built in reasonable doubt by doing this.

This DA has no idea what she is doing.

As guilty as Fierro is and as horrible and tragic the death of Mr. Tenorio is, the real crime is in the way the DA completely botched this case from the outset.

At the very best, the DA and the community should hope for a hung jury. Then, maybe your DA will go to a class to learn how to be a prosecutor and come back and do her job correctly in a second trial.

At the worst, Fierro walks on the vehicular homicide and leaving the scene and only does 90 days for simple DWI.

Either way, Santa Fe: Wake up and realize that no matter how strong your sentiments are on criminal activity in our community, the DA is inept, ill-equipped and incompetent to prosecute even "simple" cases. Don't blame Fierro's defense lawyers-they are just doing their job.

Blame the DA and her team of defense lawyers that don't know how to be PROSECUTORS!
