Gains has since been fired as a result of that incident, according to court documents. <br/> <br/>Moody contends she tried to complain to her superiors, but they dismissed her or made disparaging comments, according to the suit filed in April. She also alleges that sheriff's deputy Ron Salazar sexually harassed her throughout 2006 and 2007 with comments such as "Hey girl, you're hot," and talk of having sex with her. <br/> <br/>"It's a good ol' boys club," said Waukeen McCoy, Moody's attorney. "I just think that's their culture." <br/> <br/>Deputy County Counsel David Levy said the suggestion of a culture of harassment is "totally false" and denied that Salazar harassed her. <br/> <br/>"The evidence will come out that she was not sexually harassed," Levy said. <br/> <br/>The lawsuit seeks unspecified damages for battery, discrimination, creating a hostile work environment and negligent training of county employees, among other charges. <br/> <br/>Moody's lawsuit alleges Gains pulled her into a device known as an "extend-a-microphone," thereby striking her right cheek and eye socket, placing her in headlock, lifting her off the ground, and throwing her on the ground. <br/> <br/>The suit claims the incident caused her "severe physical and emotional injuries," though the county points out she has not described specific injuries. <br/> <br/>Court documents filed Thursday by the county show Gains disputes Moody's account, though the county is not representing him. <br/> <br/>Gains says he was "engaged in mutual horseplay to which deputy Moody had expressly or impliedly consented," according to the county's filing. Gains' attorney could not be reached for comment. <br/> <br/>After the run-in with Gains, Moody's suit claims, she asked several lieutenants for help but received none, and was later passed over for a spot on the narcotics task force for complaining. <br/> <br/>Moody said Lt. John Quinlan bristled when she said he wasn't being helpful, so she said she would go to a female lieutenant instead. <br/> <br/>According to the lawsuit, Quinlan replied: "That might be a good idea. You can get a female's point of view on this ... it might be better for you." <br/> <br/>Later, the claim states, Lt. Gil Rodriguez said: "This is like a hard day at the hair salon, I have some tissues in my office if you need it." <br/> <br/>Quinlan and Rodriguez are not named in the suit, but Moody claims the county is liable for not properly training its employees on sexual harassment policies. Deputy Gains was her friend, she got angry when their playing got too ruff, and he got fired. The Office acted quickly to fix this problem. She is now in a position of power and she is going for he money. The problem she did not tell her lawyer is, everyone knows what kind of games she likes to play, and when that comes out in court her family will be shocked about what their "little girl" is really like. She is as tuff as any man, and when it comes to sexual harrassment she could teach you a few things.
Don't judge the Office for what these consenting adults did prior to their "falling out."

Deputy Moody had a working relationship with Deputy Gaines. Which at times involved a consensual sexual banter and physical horseplay. The day of the incident was no different then any other. Deputy Moody verbally engaged Deputy Gaines with racial slurs and he responded. The banter escalated and a playful wrestling match ensued. When it was over Deputy Moody and Deputy Gaines laughed about it and went on their separate ways. Deputy Moody continued to perpetuate the incident, seeking attention from many other Sheriff's Office employees by telling the story to anyone who would listen. She told numerous deputies and supervisors (in jest) of the incident. The female Services Lt.(who supposedly helped her) heard of the incident by one of her subordinates and SOUGHT OUT Deputy Moody. After speaking with the female Lt, Deputy Moody then came forward with allegations of an "attack" by Deputy Gaines. Which subsequently resulted in his termination. Of the three witnesses in the investigation, two stated they perceived the incident to be "mutual" and the third corroborated Deputy Moody's accusations (who happened to be a friend of hers). One deputy sheriff (who at the time was Deputy Moody's partner and friend) submitted a signed declaration stating that Deputy Moody discussed the incident with him and stated the incident was mutual and in jest. Ironically, this individual is now one of the accused of sexually harassing her..........
As for her injuries (unsubstantiated according to the County), she spent the folllowing day of the so called "attack" at an amusement park riding rollercoasters with a group of friends and their children. Her allegations of inappropriate remarks by Deputy Salazar did occur, but not in her said context. She consensually participated/initiated these said conversations with Deputy Salazar and NUMEROUS other male Sheriffs Office employees(deputies, Sgt's and even Lt's.) She also was known for repeatedly sexually taunting and soliciting numerous male Sheriffs Office employees for sex.
Deputy Moody has a history of promiscuous and inappropriate behavior during her employment with the Sheriffs Office. She routinely boosted to male Sheriff's Office employees about her sexual abilities (positions, flexibility, drive, etc.) and had numerous sexual encounters with Sheriffs Office employees, her police academy RECRUITS (whom she supervised) and other law enforcement officers within the county (some who are married).
The task force position she claims she was denied due to her accusations, was given to the candidate who scored better then her and was more experienced. As you can see this was a calculated, thought out plan by Deputy Moody. For years she played the "one of the guys" role, engaged in the locker room talk/horseplay in order to gain the confidence of the male employees of the Sheriff's Office. When she finally saw an opportunity to use it to her advantage, she quickly jumped on it. Not to mention receiving the assistance of this female Lt, who has her own axes to grind with a few of the individuals named in Deputy Moody's lawsuit.
Hopefully those who read this will see what is really going on here - DEEP POCKETS!!!!
This has nothing to do with Sheriff Munks, UnderSheriff Bolanos or Las Vegas. Nor is it appropriate to use this frivolous lawsuit as an opportunity to criticize or ridicule them. It is unfortunate that a single father has lost his pension, his career and the ability to provide for his family. Many others have been publically disgraced and the Sheriff's Office is once again in the headlines over some "sex scandal" which is really nothing but someone trying to financially secure themselves on our (the taxpayers) behalf.
As Paul Harvey would say .......... and that is the rest of the story!!!!

DEEP POCKETS is right on, you people are being sold a lie. I would not put it passed Dep. Moody to try to use this to promote to sergeant in the up coming test, that is the kind of "victim" she is.

The workplace is no place to "Horsleying" around! Take the BS off premises, go to Gold's gym well after work, out of uniform and without your service weapon. We would want anyone to really lose their composure.

There is no justification for "Horsleying" around and people do get upset or tell them to take it elsewhere. It was a painful experience to be fired and this is probably a deal breaker for Moody's immediate promotion let alone scoring high enough in the written exam and subsequent exams. Merit promotions at this level becomes more political as you go up the promotion tract to lieutenant, captain. If Moody is promoted it will probably be the last in her local career. The "Big "Hunk" will cut his loses, pay political homage once to say in the future, that we did promote her; it just won't be a merit promotion. The squeaky wheel gets promoted once and retires in that grade.

If you haven't figured it out, as a victim, you have to walk away; as an pursuer, you have to turn and go the other way simultaneously or not advance further. I don't think at some point there was mixed messages and the first clues were not heeded. This pursuit was about ego, saving face and narcissism. Now people are angry for something so easy to resolve. Sexual harassment usually results in retraining and maybe a 3 day suspension; the suspended person rarely loses pay and carries it over as paid vacation leave so there is no loss in income!

This is clearly another argument for a comprehensive compliance review and audit of the Sheriff's Department -- to get everyone on the same page; in this case, no "Horsley" around!

The lawsuit is justified to get the sheriff to mitigate litigation before the fact; exercising leadership and control failed him a few months after his election and it is too bad as two careers are probably ruined.

Stacey Moody - hopefully some of the comments and actions that she has said and done in the past come to light. How many men at the Sheriff's Office have been sexually harrassed by Stacey Moody? And will any of them come forward? Interesting! To those that are not involved in the Sheriff's Office, there's no dirt going on at your place of business? Just remember what goes around, comes around.

Let us mention that Deputy Moody has somehow managed to get several "specialty" positions within the Sheriff's Office. These are sought after positions that there are many people that are more qualified, not to mention more deserving. Here are a few of the recent specialty positions that Stacey Moody has somehow aquired (I can't say achieved)Training Officer at the Academy, Range Master, and a Detective Slot in the Services Department. How can she possibly say that she was denied the position in NTF. She wasn't the best candidate for that position either. Stacey Moody is attempting to take advantage of San Mateo County's deep pockets and I hope the county doesn't just roll over and pay out on this one, cause there is much more than meets the eye.

Thank you for explaining what really happened to those that seem to believe that Stacey Moody is a victim. I agree that horseplay should not occur at the workplace, but honestly, how many of us have engaged in some sort of physical play with our coworkers? I know many people who have. She was afraid of being disciplined for her involvement and so she came up with a plan to become a victim instead. Unfortunately, Deputy Gaines, a member of SWAT for 9 years, with many acknowledgements and many awards for his service, is now "out" of a 17 1/2 year career, no income to support his family, and humiliated by Stacey Moody's lies. Deputy Gaines did not slam her on the ground, get a hold of her IA interview....its very interesting. And yes..why would she, a victim of a terrible assault, go to an amusement park,(with one of the witnesses)? Because she is not a victim. Lt. Quinlan, a very experienced well respected man, saw right through her, as did Lt. Gil Rodriguez, a man who claims to be her friend. She laughed and joked about it until a female Lt. heard about it..who also happens to be her friend. There are so many facts that were left out...Shaun Bishop needs to interview Deputy Gaines and his attorney to get the other side of the story, and get the facts!

It would be nice if those who know the real Stacey Moody would come forward. I believe that those who know Deputy Gaines will stand behind him and support him whole heartedly. He would do it for his friends, and if it were the right thing to do. We will see what happens.
I wonder also, will her academy recruit "boyfriend" be called in as a witness? She was his supervisor!

Of course number one and number two have culpability in this incident. Things like this would not have progressed to this level under administrations prior to Horsley. The Sheriff's Office began it's steep decline under Horsley and continues under Munks. Before Horsley if deputies committed crimes they would be prosecuted. Under Horsely and now Munks crimes committed by deputies, who are in the inner circle are covered up. Those who assisted in the coverups have been promoted, or given coveted positions. How can the Sheriff maintain control of his office when he himself is immoral and dishonest and surrounds himself with those who are also immoral or dishonest? The truth is he can't. He has clearly lost control. Furthermore if he has lost control on the inside do you really think he protecting and serving the community as he is sworn to do? He is not... if you only knew.

This has nothing to do with the sheriff or undersheriff nor does it have anything to do with training. Deputy Gaines is a great person who made a mistake by PLAYING around at work with someone who is clearly psycho and has no conscience. Moody's lawsuit is absurd and anyone who has spent any time around her should know that! I hope she sleeps well knowing she is ruining peoples lives.

The Munks and Bolanos in Las Vegas is not a separate issue. Since that debacle moral has taken a nose dive and the hits keep coming weekly.

Munks is a "lame duck" leader we had great hopes for him to right the wrongs of Horsley. His deputies like him, but he has abandoned us. Horsley played favorites, and dumped on everyone else. Will someone step forward and run. HELP!! Gains was a jerk, glad he is gone, but Moody is a snake in every way, and she makes Gains look like he got a raw deal. Bolanos is Munk's "hitman" he should go back to running a small third world country.

Some one run for Sheriff, you have my vote. I like Munks, but he is M.I.A.

Filing a claim against the County is just a family tradition. Her brother filed a claim of harassment against the Sheriff's Office/County as well after failing his training program. Boo-hoo Deputy Moody...way to ruin your friends careers for a few bucks.
