Moments after a judge stayed pending appeal Edith Delgado's two-year jail sentence for the car crash that killed a Tongan royal couple and their driver, he ordered the Redwood City woman back into custody and more than doubled her bail to $100,000.

As one member of the Delgado family sobbed, the teenager was cuffed and escorted by bailiffs out of court Friday morning.

"The family has to get together and post the bail," defense attorney Randy Moore told reporters outside of court. "I expect her to be out today or tomorrow."

"We're going to get her out," affirmed 30-year-old Juan Delgado, Edith's older brother.

"It's not really a tragedy - it's an inconvenience," Moore said.

Delgado, who was scheduled to begin her two-year jail sentence today, already spent 11 months in jail before her $1 million bail was reduced to $40,000 after her conviction of lesser charges by a jury in July.

San Mateo County Superior Court Judge John Runde justified raising Delgado's bail from $40,000, explaining that the conditions of Delgado's release had changed since he imposed her two-year sentence exactly one week ago.

Although the judge did not explain further, Moore said he assumes the judge raised the bail amount because he considers her a flight risk.

Earlier this week, Moore filed an appeal to the two-year sentence, contending that two years is excessive for a misdemeanor that typically carries a maximum of one year.

Delgado faced a maximum of three years in jail for the misdemeanor offenses in the high-profile case, which has drawn international attention. The victims of the crash included Tonga's Prince Tu'ipelehake, 55, and his 46-year-old wife, Princess Kaimana Aleamotu'a Tuku'aho, who were visiting the Bay Area on a political reform mission.

Delgado was speeding on Highway 101 in a Ford Mustang in July 2006 when she sideswiped their Ford Explorer, authorities said. The vehicle rolled several times, killing the royals and 36-year-old Vinisia Hefa of East Palo Alto, who had been chauffeuring them.

Prosecutors contended that Delgado was not only speeding, but changing lanes erratically while racing another vehicle. They argued that Delgado should be convicted of misdemeanor vehicular manslaughter with gross negligence, which calls for a person to have disregard for human life.

The defense admitted that Delgado was driving recklessly, but argued vociferously that the prosecution could not provide evidence that she had been racing another vehicle. They argued that the jury should not convict the teenager of gross negligence.

Ultimately, the jury sided with the defense, convicting Delgado of misdemeanor manslaughter charges without gross negligence.
She is just your typical whiner. Even if she got probation, she would complain. Someone should put her in her place and seal that trap shut.
She killed three people due to ignorance and got off because her VICTIMS were of color.
The electric chair would have been appropriate.
Perhaps the victims family should sue the crap out of her?

Electric Chair...? The maximum sentence was 3 years for each count.

Where is Stanford, CA by the way?

Two of the three victims family has forgiven Edith and are now suing Ford Motor Company for faulty engineering of that miracle of modern technology called The Ford Explorer. That truly is what killed Prince Tu'ipelehake, Princess Kaimana and Ms. Hefa on July 5th 2006. A sidewipe accident, where the Ford Mustang gets some bad body damage and the Explorere flips 2-3 times.

However, as a Juror on the case, I was disapointed she appealed her sentence

Ah, the great anomaly; few people realize it is a community (and not just Stanford University) and has a special provision in the penal code for a police department...; a few other places like that or recently revised in the law.
