We've been reporting that a 24 Hour Fitness Club in Moraga is now a Super Sport Club. What's the difference? Higher monthly rates.

That's about it according to members who say the amenities don't measure up to the Super Sport Club described on the company's web site.

"Basketball courts, we don't have that. Racquetball courts, we don't have it. Pool, spa, whirl pool, juice bar, tanning facilitates -- we don't have any of that here," said Rich Phifer, a 24 Hour Fitness member.

Members like Phifer think 24 Hour Fitness named the gym a "Super Sport Club" just to hike the rates. He, like many other members, bought lifetime contracts to lock in low rates. Now, 24 Hour Fitness said they have to pay more for the new gym, or go somewhere else.

After our report, dozens of members took their complaints to the Contra Costa County District Attorney.

"One of the things I hear from consumers is,'Hey this is a bait and switch. Where we were promised one thing and now I'm being forced to either drive to Walnut Creek or pay $10 more.' And that does go to the issue of fairness," said Steven Bolen, Contra Costa County Deputy District Attorney.

Bolen is working with 24 Hour Fitness to make sure they honor their agreements.

"What we're doing right now is just trying to evaluate the contracts people signed to see if the contracts were being adhered to," said Bolen.

Bolen said one option may be to get members "grandfathered" in, so they can use the club without a fee increase.

"We want to get this resolved one way or the other within the next 30 days," said Bolen.

In a statement, 24 Hour Fitness said, "24 Hour Fitness has been in contact with the Contra Costa County District Attorney's office regarding member requests for access to our new club in Moraga. We will continue to respond to any requests for information and communicate with our members on this issue."

I would like to know if this gets resolved also. I have a simular situation with access to the Millbrae club. I currently workout at the San Mateo club, but they opened a Super Sport Club in San Mateo also. My guess is they'll close the old San Mateo club to force older members to more expensive upgraded memberships.

These guys are well known to overpromise and underdeliver - they lack professionalism. Customer service is in the gutter.

Less than 4 months ago, I was told that my pre-paid membership would be grandfathered to the new Mountain View Super Sport Club. I would not need to do anything or pay extra for upgrade.

Today, I reported to the new club and was told there is no grandfathering as the old club is not closing. Now, I am told I will need to pay $20/month for use of new club.

This club changes rules as they please!! Poor communication and lousy customer service. If you are thinking of joining a club - go elsewhere.

yeah! Thanks probably to the Contra Costa County DA, 24 hr is so sorry they messed up, they rescinded the price increase and will refund you w/in the next 60 days. They love their old members. my sister who quit, is being offered her own $19 monthly back. We all get an auto upgrade to all Super Sports in the country (which i'm told by the sales guy is everything but Derke Jeter NYC- but of course he's just the sales guy. Never trust a 24hr fitness sales guy).

I currently work at 24, and I cannot agree more with everyone. I think if there is any investors out there looking for a new business they should open up a new fitness center chain in the bay area. with the bad reputation 24 has been receiving it might be a good time to learn from their mistakes and start something new.

hmm...well, looks like those contra costa members were fixed. Weird. I knew the workers at 24hour aren't necessarily the best in customer service as a whole, but I'm sure there are exceptions. But I didn't know it was that bad until I read this forum. Total Bait and Switch, tho' from what I've read.

I went to the Mountain View Super Sport when it was just opening, and on a Sun. during the day, got in, no prob. went in after work that same day, and guy said my membership wasn't a Supersport, had a manager come see me, he asked me what my current membership was, and said I'd have to upgrade in order to go to this Super Sport. He said it would be 20bucks per month like everyone said. He let me in that day to try it out, but I haven't gone back.

I understand the idea that a Supersport is supposedly higher grade, even though, in my opinion, not so much. Just everything was new, Pool was longer. Steam room was clean. Locker room has free towels. Showers have all individualized with doors, but I hear they are like that for the womens showers, cause my sister told me. So, all in all, not really worth it. I'd rather save my 20bucks per month or use it for something else. I did like the full size basketball court, as I'm big time on balling, but not 20bucks per month.

Ya, when I told someone at my work they just built a new gym nearby in the same shopping area as the old one, the logical response she said was, so is the other closing?? I asked, and they said no. Seems odd to have 2 gyms almost right next to each other. I'd think the people going to the new one is not very many, unless those people already are SuperSport. When I was there, hardly anyone. But now, who knows?, as I haven't been back.

I'd sure like to have my membership grandfathered in, as I joined at the reg/non-supersport Mtn.View one. Oh well. They should just convert everyone.

You are all just mad because you feel entitled to something that you don't deserve. When I signed up I was aware that if larger gyms were built then I would not have access if they were higher levels. I have sport and had a super sport option when I enrolled. I chose not to and now there is one by me in laguna. I can't be mad because they keep building , I have others five minutes in any direction that I have access to so boo hoo to all of you.

Mike - You must nor realize, after building Supersport,they closed the old club in Moraga, which leaves members no option but to drive MUCH farther to club in Walnut Creek.

24 hour fitness in the Bay Area are so disgusting and not enough like Southern California. I'm glad 24 hour fitness upgrade to Super Sport. Anyway, thinking as a business person. I would do the same as 24 hour. Build new fitness center and charge customer $10 to upgrade in the beginning to cover overhead cost. How are new things built for free? People always want things for free.

In So Cal., go to 24 hour or pay much more for LA Fitness, Sport Club LA (Irvine), Equinox - all are $30-$200/month. Sport Club LA is luxury. Oh Ultra Sport 24 Hour is in So Cal as well.

So 24 hour really need to compete with other luxury gyms. So in order to compete they have to build better gyms.

All the old 24 hour gyms are disgusting. 24 will be around. The young new members will pay for their services and facilities.

Pay up or run and workout at home.

24 Hour Fitness depends on people signing up and then not using the club after a honeymoon period of a few weeks. Very few people continue to use a health club after a few weeks.

This is a breech of contract with this super sport BS. I would join a class action Lawsuit for what they are trying to do.

I was told my lifetime membership included all clubs at time of purchase regardless of what they call it, its still a 24 hr fitness. They may get away with this with new members but they can't with existing ones.

Yes, here in El Cajon Cali they opened up a new Super Sport that is not worth the extra $10.00 so are you telling me I can fight it? I received a letter in the mail regarding the class action lawsuit. I would like to know how i go about getting my old rates for ALL ACCESS TO ALL GYMS

My contract says "All fitness clubs and Sports clubs"
"Does not include access to sporting clubs" At the time I signed up the only sporting club was Irvine CA. There was No such thing as a supersports club.
I renewed my contract back in 2002, but I was an all club member since the mid 90's.
The nearest club closed and a SuperSport club opened. But now they are telling me that I can't go there? WTF??
Can they do that?
