You don't have union workers working for your company next to non union workers, if you did you would know the details involved in CBAs,
By Law, you can not compensate a union member any different than a non union member working for the same company doing the same job.
It's against the law and CBA to compensate employees in the same class unequal because one is a union member and the other isn't.
End of story.
If the proposal goes through, CBA and CEA employees are expempt.... Those employees covered by the CBA do not have to be union members.
