Appears like the ProtectMarriage.com group found a patsy to try and halt the right to marry for Same-Sex Couples.....and I don't think this is going to work anymore than when Imperial County Clerk tried it.

Either do your job or resign and let someone else do it!!!!

Plain and simple in my opinion!

I don't like to see folks lose their job, but when they want to refuse to do their job......then they need to be fired.

The proponents of Prop 8 haven't figured it out yet.....they lost this battle......it's time to move forward!!!

This is more of Andrew Pugno's shenanigans
.
Andrew Pugno is the rabid anti-gay co-founder and lead counsel at ProtectMarriage dot com. He coauthored Proposition H8, and continues its legal defense. Pugno began his efforts against same-sex marriage in 1995 with then-assemblyman Pete Knight (now deceased)
.
Pugno is in serious debt from a failed bid for public office and he needs to keep the propH8 cash cow grazing until he gets his debt paid off

What happens when one doesn't obey the law?
What's the big deal here?
The clerk should be fired, fined, arrested or imprisoned.
Instead, it's made as a shock story to keep people fighting and distracted.

Look what happens when Civil Servants are allowed to think it's within their authority to decide legal issues, and that they can refuse to fulfill their job descriptions?

I know.....how silly of them to do anything but what they are told to do and I'm not sure he could prove he was actually being harmed by issuing a marriage license to a Same-Sex Couple......pathetic!!!

If Attorneys General can just blow off their job description, I guess a Court Clerk can also.

So, you believe it is okay then for this County Clerk to disobey the law......is that correct? Is he being harmed or is he harming the rights of Gay and Lesbian couples who simply want to marry?

Ask the AG who refused to do HIS job. Wait. He's Governor now.

The AG and Governor have the right NOT to defend UNCONSTITUTIONAL Propositions.......and I think the argument that ProtectMarriage.com is using regarding needing an appellate decision before a Proposition is consider unconstitutional could really bite them down the road considering that there have been many propositions that were voted on and passed by the people, yet challenged in Court and were NEVER signed into law.......and you seem to believe that what the proponents are doing is okay..,....and I disagree with you!!!

You keep saying that. Others keep saying that. The AG's job description does not.

Nothing is "unconstitutional" until ruled so by the Court of Jurisdiction. Nothing.

Interesting because both Prop 63 and Prop 187 were ruled UNCONSTITUTIONAL and therefore NEVER signed into law even though they were both passed by a majority of voters.....NO APPELLATE ruling declared those props unconstitutional.......yet gone they are.....but this is different, why?

The constitutional challenges were heard and decided in a Superior Court of the State of California

The State Appellate Court refused to grant Cert.

They were not decided by someone not on the Bench.
