Babysitter sentenced to 18 years for crippling a child

The Schenectady woman found guilty in April of smashing the skull of the 2-year-old she babysat a year ago was sentenced this morning to 18 years in prison.

Rebecca Polomaine, 31, of 475 Alexander St., was given her sentence at an emotional hearing that included statements by both parents of Riley Gilbert. Riley is now 3 and cannot talk or walk and is blind, the result of a severe brain trauma she suffered when Polomaine smashed her head into or onto a hard surface.

"Everyday, I come home and my duaghter cannot run to me," Riley's father, Brad, said in court this morning. "She can't say hi to me. She's stuck in a chair." Full Story

In the case of this innocent defensless child I tend to lean that way. I, like many other people tend to get worked up over cases involving helpless victims. We have a legal system for a reason and I practice non-violence so I could never do such horrific things to another human being. Human nature makes us want to, but truthfully-it isn't right.

unfortunately, we see news like that almost every day. like that woman who scalded 3-year-old's feet as a measure of punishment. or a man beating a 7-month-old stepson. can't we, as a society, do something to prevent this? we just have to keep our vigilant eye out for possible signs of abuse.

And report them if we see them. I've heard people say that they didn't report possible abuse because they were afraid of being sued for fraud. I believe a possible solution is two step. First-remove the threat of retribution for reporting abuse where substantive evidence to do so exists and second to solicit child advocacy organizations to encourage the public to report abusive situations.

i don't understand why they are worried about being sued for fraud! by child protective organs? the name of the informer is never disclosed to the possible offender. of course you can be sued if your accusations are totally unsupported. and system abuse is suspected (like means of revenge, for instance). but that's rarely the case. if something's really fishy, i believe the organs will be able to pick up on that.

It is unbelievable how mnay haters there are out there, these people do not take into account all of the CIRCUMSTANTIAL evidence. There are thousands of men and women in prison who are wrongfully accused. Rebecca had no child abuse priors, four kids of her own and could have taken a 5 year plea bargain but she stuck to her guns and maintained she did not commit this horrible act. Instead she got 18 years in prison. Her children will grow up with out her love and caring. Remember folks- Our Justice system is BROKEN DOWN. Judges are NOT what they should be and many are totally devoid of integrity. It is all about who has the more influential lawyers. These lawyers are bottom feeders who only care about their prosecution record. It is shameful and runs rampant in our court system. Lawyers are a dime a dozen now a days, however 8 out of 10 of them are a disgrace. When one lies down with dogs they wake up with fleas, in many cases there is not the financial means to retain the top notch lawyers, that's when the bottom feeders move in. I pray for Rebecca and her family. I hope she is exonerated some day SOON.

Find out all of the facts before you say anything. Rebecca had previous unfounded CPS reports. Unfounded because they didn't do anything on them. Her daughter had two previous injuries... so check the facts... again.

I know rebecca personally and i can honestly say i believe she is innocent. I feel sorry for the child but the justice system is so screwed up, you have murderers, rapist and pedifiles roaming the streets while innocent people like rebecca is in jail and her 4 innocent children suffering without their mother. For all those who want to run their mouth and speculate, you can do so but to those of us who knows rebecca, we know she's not capable of doing this harsh crime they charged her with. Its ashame all of you who have nothing good to say about her don't know her at all and is so quick to voice your opinions.
