tell me , how can you restrain people who weigh two hundred lbs and are into fighting and drunk? Will they listen to you at one AM at night, i beleive the fighters were beyond reason and Emery came out of his condo swinging, he had been arrested for giving people stiches in Florida and Oceanside , he had a temper, he was on parole The people in high places that Hank knew are still behind him and defend him so that they must think that something is still okay with Hank the press is over the top They researched Hank computer; he never speaks about Jews, Blacks, or any race as he was friends with Mexicans, blacks, etc and played football with them, one of his best friend is Jewish so it does not fit the description at all The one with a blog is not him for sure The press is exagerating Thank you Moose for answering Have a good one

Anne Marie, what are you talking about you "knew" Hank. Um, it's your grandson, remember?? I hate to break it to you, but while Hank IS one of the defendants he's not the "star" defendant. Every blog about the Bird Rock Bandits I know you're chompin at the bit to spread the word about what a swell guy old Hank is. We KNOW that Hank and Doug Flutie are B/F/F but I have news for you Anne Marie, nobody cares. Your grandson will probably only receive probation so I don't know what you're gettin so worked up over, you're on the French Riviera, go get yourself liquored up and give up trying to convince everyone on the internet what a prince Hank Hendricks is.

the statemments are wrong, no, its not like that : besides i do not drink i have been gone a long time, i am entitled to my opinions i write because there is so much anger from people who do not know the real story and do not read the articles, depositions, etc get the facts, dont be mad , cool it , the court will sort it out

I live a mere few miles from the scene of this most unfortunate and tragic episode. Say it was out of jealousy, male competition to get the girl, whatever, but this guy didn't deserve to die. I work the SD DA's Office and while I am usually on the defense side, I think that each player's role should be taken individually. Some are more culpable than others, but the end result is that an innocent, talented, young aspiring surfer was senselessly killed really as a freak accident. We are having the prelim right now and these people are in a ton of trouble and may spend their young lives in the slammer. Whatever your opinion, this is a tragedy and our hearts go out to ALL the families of both the victims and perpetrators. La Jolla may be a sort of paradise, but paradise has its dark,ugly underbelly.

As accomplices in a murder, all parties share equal guilt. One person may have landed the fatal blow, but the others offered encouragement, enticement, facilitation, planning, assisted in battery and share guilt equally for murder - the act of taking someone's life. When it comes to murder, there are no degrees of guilt. Everyone of those rich terrorists gangsters needs to rot in jail until they are too old to screw with civilized people.

Hi Moose i weep tears of regrets for the whole incident for Emery, for his mom, family, friends, the families of these kids the only consolation that i have is that poor Emery had no marks on his body only the blow and crack from the fall to his head which would prove that he was not beaten afterwards there is also a testimony to that fact in the courts given by a policeman if you live out of town far away for several years and come the day before how do you know how your friends have changed ? what their emotions are all about ? what is their agenda if you are so removed and far away and they invite you for a get together? I only look at the press releases

They better hope they go to the pen. When the red and white finds out their name was dropped in the court room, them boys are going to have a little "talk to" from local 81. In the pen or on the street, these clowns are SCREWED!!!!! Any way you look at it, they are finished.

I think that these kids should go to jail for about 6 full years for ganging up on this man.It does not read like the kids went there to kill him or killed him on purpose.I think its crazy that anyone wants to try these kids as a gang.The prosecutor should try his hand with the angels and leave the kids alone.I feel for the family of the dead man but ruining 5 kids lives is not going to bring him back. I think these kids can learn and become good citizens.

Oh, and by the way, NONE of them did anything to stop it. They should be removed from society for impersonating a human being.

I went driving around La Jolla to go see the tide pools on wednesday and came across Bird Rock St. I'm not sure if these "Bird Rock Bandits" are from this street or just "claim" this street or whatever... but what i did notice were the million dollar homes. Yep. That's right.
You "Bird Rock Bandits" are nothing but spoiled f-ckn brats.
should have listened to mommy and daddy and gone to college!

hendricks and emery were both high acheivers in court hendricks name was never mentionned by an old accuser, when he picked up Grosso, Emery and Eric got up and thats when the fatal blow came in people liked Emery and Hendricks for different reasons, they are still loved by their friends , no one ganged up on emery, he had no marks of blows said the autopsy no one saw Hendricks that night he willingly went to the police to tell them that he was there

But if he wants to convince people that he's a good guy, maybe he should have instead of grabbing Grasso off of House. At least if he would have done something to show that he meant well. I've been around a lot of thugs. I grew up in the Bronx in New York and lived in LA for close to 15 years. I've seen a few thugs in my day. None of the defendants looks like a "nice guy." Hendricks is just as guilty as the rest of them. He was there and did absolutely nothing to stop the fight or intervene in any way. He was part of the problem and should pay his share.
