Yes the po-po can search a vehicle for several reasons WITHOUT a warrant. Even though the Arizona v. Gant ruling limited one of those instances, I repeat, po-po can search WITHOUT a warrant.

I've known several people who told cops they could not search their vehicle without a warrant and the cop didn't do squat. The only way they can do it is if the evidence is in plain sight or often they try to trick you or use intimidation. Same for inviting police into your home, you can simply tell them no and get a warrant first, they have have to comply. This is the LAW! If a cop wants to ask you a few questions, you first ask if you are being detained or under arrest, if they say no, then you simply refuse to answer their questions. This is the LAW! People don't know their rights and cops try to take advantage of that.

Then please enlighten me (by using case law) to prove that there are no other warrantless exception to searching a vehicle or a residence.

I however doubt you will be able to. You know how I know this? Because you are wrong. There are several warrantless exceptions to searches. Also you have to keep in mind the the US has 11 different appellate courts by region. Each one of the courts has upheld standards that my be slightly differing from another.

However, your comment stated that the only exception is "plain view" and that is wrong.

So, put up or shut up. Well it's highly unlikely that you will do either but it doesn't matter because ignorance is bliss...

There's a very good reason why cops need your permission to do certain things. They need you to say yes, like inviting a vampire into your home. Two exceptions to the rule, there may be more but these are the two main ones, a crime is being committed in their presence (rarely happens)and also probable cause. The second one better be real otherwise they can get into trouble. If you tell them not without warrant there's nothing they can do if it doesn't fit into one of those two criteria. A big chunk of police work is trying to convince people they did wrong even if they didn't do anything. There's a ton of info on the web about what a cop can or can not do. People like yourself who never made it past the third grade need some edjewmakation.

Never had a problem till last year which has now become a never ending problem. Too many details to go into but essentially there is alot of orruption, especially with regards to DUI's. I understand the stresses of the profession but there is no excuse for dishonesty, harassment, or bullying. Every job should be done with honesty and integrity. I shouldn't have to be afraid of the police (unless I AM doing something illegal).

The FACT is, the reason you cannot quote case law is because you are wrong. If you brother really is "cop" than it should be easy for you to quote some case law. I have referenced case law already in this discussion including SCOTUS decisions.

funny I found this site while I was looking for Charlene Lewis. March 9, 1998 OFFICER rON mANAIGRE AND i WERE TALKING A BREAK IF FRONT OF EASTERN DIVISION 9225 Aero Dr San Diego Police Department. I was working light duty as I did NOT KILL someone April 27, 1995 I could have but, chose a hands on arrest would work. It took 10 officers to finally get Garry Franklin in custody. Turned out I had fractured shoulder and ruptured disc L5-S1. I did not have a firearm on me at the time due to recent back surgery. I looked for a rock or anything to nail her in the head but, no such luck.......Ron finally shot Charlene and down she went.
Charlene was apparently trying 'suicide by cop". She was sentenced to 6 years (served about 3) and got the psychiatric help she needed......I am now an unproductive person to society and never can be.
The person to suffer the most is my now 16 year old son.........My family would be much better off if I had died. The State and FEDS take very good care of families where parent dies in line of duty. When I hear of fund raisers for'widows and orphans" i am sickened..........San Diego Police Department and the so called union allows treat of an imjured officer that can never return to being a 'real cop' like a 'piece of worthless crap'. Most are given tasks where ther have to sit for 10 hours and do 20 minutes worth of work. At the time of me typing this is took over 2 years fro Medical Retirement to be approved.
Despite my injuries, working patrol. and seeing how Division Detectives work........Cops are OVERPAID and Regular Service RETIREMENT benefits are way too high also.....I loved law enforcement and was thrilled with the pay. I just could not afford to buy a new $30,000 car every year..........If you hear of an officer severely injured they need your help.........Any feedback? scherer.3@hotmail.com
