Lawyers Battle Bird Rock Bandits 'Gang' Allegation

The five men accused in the death of a professional surfer last year in La Jolla were in court Thursday for the second day of their preliminary hearing.

Prosecutors asked witnesses in detail about the incidents, which, in some case, witnesses said, were started because non-local were coming to "their" beach.

Case closed...they're claiming turf and threatening outsiders who use "their" beach. That, in and of itself should meet the criteria of a frick'n gang! You don't need "colors" or throw hand signs to constitute being in a gang. Their behavior, alone will qualify them as gang thugs. Also, what does it say about Seth's moral terpitude and personal integrity when he makes the choice to align himself the the frick'n Hell's Angels, and to be role modeled into an animal who thrives on violence and whose sole purpose in life is to seek opportunities to engage in fist-fight challenges, just so he can have the sick pleasure of pummeling people who are no match in size and physical strength? That's the sign of a pure bully, and his cowardice (by having his cronies accompany him) is disgusting and reprehensible. Seth, you are one unattractive, ugly mother phuc-quer!! Every time I see your ugly mug on the news, all I want to do is beat the live'n $h*t out of you for the terror you and your disciples of violence reeked on the Beach area!

if anyone owned that beach it was Emery the surfer, he lived in front of it and pretty much owned the area like his own turf
the guys did not have the same participation as Seth did , thats his problem he will have to deal with it but Emery who was a good kid also had a trigger temper and came out swinging that night, he could have stayed safe in his condo
He was on probation for beating a guy in Florida and another one in Oceanside, yet he should have never died poor kid , he should be surfing and his poor mom must be in real pain; drinking is a bad deal for everyone around
some of the other kids did not participate in this ; eric house spoke to grosso emery's girl friend and Emery gor teed off and threw beer at
eric house; this kids were friends since way back in school , they were not into territories, their homes were close together

It's about time justice caught up to these surf bullies who proclaim a public surf area be "their beach". Prision time will do them "good" and the public by keeping them from terrorizing other lawful surf users.

Wrong, Anne Marie...Emery didn't own that beach either. He and his friends spent most of their time unemployed and not payng taxes. As far as I'm concerned, anyone who doesn't contribute to local and state taxes isn't entitled to claim ANY turf, whether they're a so-called "Professional" surfer or not. As far as I'm concerned, these guys were nothing more that professional thugs and bums. Their sporadic employment as construction bums doesn't count either. These guys weren't achievers and didn't graduate from college. It's also probably safe to assume that none of them graduated from an organized certified construction trades training program either. Don't defend these guys...all of them were bums, even the frigg'n college quarterback who didn't have the courage to take the high road and say, "no" when his a-$-$ hole friends conspired to follow Emery to his mother's place to beat the $h*t out of him. Emery's no saint either. If he has a criminal record of enticing fist fights, just like his stupid "Bird$h*t" Bandit disciples, then he's no less culpable. He just became nothing more than a victim of his own violent lifestyle, which obviously back-fired on him. None of these boys had proper mentors who would've long ago taught them coping skills and anger management. Their style of problem solving was to simply pummel the $h*t out of someone. Now, they're paying for it and law-abiding citizens should be rejoicing that these guys are no longer a threat to the general public. Screw all of 'em, and their friends who post here in their defense.

I don't know any of the defendants other than my nephew Matt Yanke. Matt made the biggest mistake of his very young life by following his so called friends on that fateful night. This was a very stupid fight between a group of drunk kids. Why is there no talk of the bar serving drinks to minors? Matt was not 21 at the time of the fight.
It's very easy to criticize the life style of these kids as spoiled rich kids. My brother simply tried to provide for his family and is by no means rich. He also tried to discipline Matt but anyone that has children knows that is not always easy. It becomes even harder when parents divorce. Parents that have "good" kids should thank their lucky stars. Sometimes no matter what you do your child ends up doing something wrong. My heart goes out to all the mothers and fathers of these children that are now facing a possible trial and to Emery's mom.

these kids were friends , i have learned that both Seth and Emery were Hawaians , a fact that i did not know before , they both lived in Hawaii and , according to the people to whom i spoke it was a terrible accident not a premiditated murder
they drank and a lot of kids do , then they fought over a girl: emery and Eric House but this time it ended up in tragedy

Whether or not he was 'professional', whether or not he was employed and/or paid taxes is beside the point. Don't you think -seriously? He was murdered and maybe you need somebody close to you to be murdered in order to feel like I do. But, murder is murder -they went to fight and you have to assume it could get out of control and anything can happen. So while it may have been an accident, it was murder. I was not aware of the under age thing but that absolutely should be researched and proper punishment assigned.

I'm with you, Barbara - the fact that this young man was murdered - do the crime, pay the time. There's never a good reason to kill someone. An accident? I don't think so - not when someone decides to go after someone else. That's called free will. Does it matter that Emery knew Seth and they hung out together at times that it justifies killing him in this disgusting manner? Not to me. Maybe it felt special for him to be the bully that he was - it built up his ego. He's had numerous problems in the past - is a sociopath to me. He and his other friends shared the experience and they all need to be punished. They went after Emery after that incident at The Brewery - they had the opportunity to drop it. They had the opportunity for change in their lives. Years ago - at least 15 - I remember when I took a group of boys to go surfing that there were kids taunting others to get off the beach. It was only when we 6 parents perused the area that they backed off. They didn't want us to hear what they were saying. Our kids were just about ready to graduate from high school and I sure didn't like what I saw. I will be happy to pay my taxes if only to keep Seth Cravens behind bars. What a shame that his parents didn't get him the professional help he so needed at a younger age. And, just because they live in LaJolla doesn't mean that they are exclusive to the laws of our land.

Mom of 2 - Peace be with you and your family -your story is unsettling at the least. It is hard to believe that so much unrest occurs near the water. Sounds sappy but I always believed people were calmer when they lived near the water! Well, it is a crying shame he never got the help he needed and his parents need to live with that (another very sad thing for them to live with). I pray he does the time and so do the others. I had not heard about the under age drinking at that bar until the guy mentioned it on this chat. Is that something appearing in the local story? Is that being pursued by authorities?

I think that these kids should go to jail for about 6 full years for ganging up on this man.It does not read like the kids went there to kill him or killed him on purpose.I think its crazy that anyone wants to try these kids as a gang.The prosecutor should try his hand with the angels and leave the kids alone.I feel for the family of the dead man but ruining 5 kids lives is not going to bring him back. I think these kids can learn and become good citizens.

as it came out in court; emery had one wound only to the back of his head; no traumas to his body, showing that no one kicked him when he was down
one blow to the chin and that was all the autopsy shows causing him to fall back on his head , they did not gang up on him , after the court we know that from the evidence given by specialists
they were not a gang and when emery was kicked out of his home by his mom, he stayed at the home of one of the defendants; they were friends since way back in school; no racism ; emery was part Hawaiian, Seth is part Samoan and Osuna is Mexican , so let the truth come out from each individual involved
it was a tragic , sad event for all the moms involved specially emery's mom she must feel terrible and we pray for her and emery

Stranger, I can't stand people like you who say such stupid shit - when you clearly don't know what the fuck you're talking about. "The problem" is that white kids, gang members, whomever, they are entitled to a TRIAL first before they "rot in jail". Please explain how the "law seems different" when the judge ordered the 5 men to be held over for murder charges in a jury trial after the Preliminary Hearing last week. Why you don't you take your ignorant self down to Superior Court sometime and see how the system actually works before you jump to conclusions. How is Seth Cravens being "treated good" as he has been in custody since last year? Have you also considered that at least in this case, the other 4 don't have juvenile criminal records and as such they are able to be out "O.R."/lowered bail until their trial. Your Mexican and black gang member boyfriends probably don't have that luxury because they have a history of delinquency. You're a fucking idiot. Grow up.

I was in agreement with you until you threw in the black/mexican thing. These scum are all charged with murder and had high bails set. The fact that their parents, except for one, could afford to post their bonds has nothing to do with the color of their skin. In fact, I'm sure most of them had to put up their house for colateral. They probably sweat the load every night wondering if their sons are going to jump bail and lose it all. Yes, they're dirtbags and deserve their just punishment but I don't think the color of their skin is a factor at all. White people go to jail everyday.
