criminal insanity & legal pardons

The legal system is equipped to investigate cases involving criminals who may be diagnosed as insane and hence partially unresponsible for their illegal acts.
Psychologists claim that patients suffering from sleepwalking maladies report worries about committing crimes "unwittingly." While such reports are not comforting emotionally for the families of the victims of such crimes, such reports do reveal an intellectual responsibility for analyzing such crimes.
Vehicular manslaughter is a legal event relating supposedly faultless car accident related deaths.
While religion of course preaches empathy, legal procedures must account for the necessary incarceration of dangerous criminals regardless of their emotional motivation.
How then do we discriminate between pardon-justified criminal insanity and incarceration-mandatory dangerous crime?
Psychology offers ongoing research into treating criminal behavior and analyzing subconscious motivations that render people incapable temporarily of judging between right and wrong.
Such legal philosophical considerations touch politics as well metaphorically. How should social leaders address ethnic-biased Affirmative Action policies designed to assist minority groups towards economic health despite obvious educational impediments? When should we use pity as a justification to create paternalistic forms of labor pardons?
Hollywood (USA) movies such as "Mystic Pizza" (1988) and "Batman Forever" (1995) explore imagination ideas regarding humanity's curiosity abou cathartic emotion indulgence. Can such movies serve as social symbols of a certain assurance of altruism wisdom balanced with social peace?
Are they printing movie posters on hemp/recycled paper yet?
