No, if you read the real decision it says that atheism is protected under the 1st Admendment the same way deistic religions are.

Would you care to define what you mean by "proselytizing"? According to Webster, "proselytize" means to induce someone to convert to one's faith" or "to recruit someone to join one's party, institution, or cause".

How does openly stating the atheistic position equate with proselytizing?
