A few major problems with your post here:

1 - Atheism is not a religion in itself for the same reason that lack of a belief in fairies is not a religion. HOWEVER, it is covered under the umbrella of religious freedom laws in the same way any religious group is also covered. Hence in strictly legalese terms it can in effect be considered to be the same as any religious group for legal purposes.

2 - John Calvert is an idiot.

3 - ALL science is "materialistic". Therefore gravity, germ theory of disease, plate tectonics, weather, whatever - it's ALL "atheistic" in that way of thinking. So your buddy there is making two steps into the dogshit in one jump - he's admitting his only "scientific alternative" is GODDIDIT WITH MAGIC, and also, Goddidit with magic is illegal to teach. While "materialistic" science isn't. So while atheism cannot be promoted in public schools, all that nasty old science stuff that you don't like because it doesn't gel well with your baseless religious opinions CAN be.

Many towns/cities have the "no jaywalking" on the books, but only trot it out to use as a tool, for some other crime they are really interested in. In that latter case, they arrest the suspect for jaywalking, so that they may do a more careful search of his background.
