You cited creation of a commissioner, not the Internal Revenue Service. Your claim was that Lincoln created "The IRS".

On July 9, 1953, the Secretary of the Treasury, G. K. Humphrey, created the Internal Revenue Service; Treasury Order 150-06, without the approval of Congress. Lincoln was long-dead.
