Barry Beach to get new hearing in Poplar murder

Barry Beach, convicted for the murder of 17-year-old Kim Nees near the Hi-Line town of Poplar, is about to get another chance to prove his innocence.

I am very pleased to hear of this discision. Was beginning to wonder if there is anyone out there who cares about others in these situations.I truly pray there are some honest people who will be able to come forward and testify about what "they" saw that night. The rancher, the barmaid. Barry,s sister and any others who are willing to tell the truth.I will not even get into the ones who were supposed to be upholding the law. It was truly something that should never have happened. If smart detectives from "cold case files " would get on to it I,m sure Barry will be released from aplace he should never have been..What is the state of Montana going to do , to TRY and compensate for what this man has been deprived of all these years? Its truly disgusting!

He is most likely innocent but even if he was guilty it should have been considered second degree...and he should have long since been released and paroled...30 years in prison for second degree murder by a teenager...is not consistent with our system regardless of him likely being innocent...

This man is innocent!!! There should be an outcry for his release. Why is the prosecutor not looked at for this obvious coverup.

The law enforcement had hearsay. There was no crucial evidence. They went on the confession of a young boy who was scared. The facts from the Centurions is what needs to heard. Now those are facts, not hearsay. Small towns oftentimes do this. It can be a setup. Let the poor man go free. I believe Sissy Rees, or whatever her name is, did it or has something to do with it. This man has spent all of these years behind bars for nothing!!!!

You people that write from all over the country are a symbol of what is wrong with this land. I would venture to guess that most if not all of you have never met Barry Beach.You saw a special on TV that told you what they wanted to tell you and you swallowed it hook, line , and sinker. You saw Mr. Beach manifest a compelling plea of his innocence. He appeared humble and contrict, perhaps even religious. You might have "researched" his case on the internet which is full of very well intended but totally naive and misguided people, pleading his case. I KNOW Barry Beach! I know him as the manipulating, knieving, deceitful person that he really is. You all must believe that the dozens of people; police officers, detectives, district attorneys, and judges that have actively investigated, prosecuted and reviewed this case were either all involved in a conspiracy on a par with the Kennedy Assasination (which just so happens to be the story that Mr. Beach circulated around the prison that houses him), or they all are the incarnation of incompetence. Don't get me wrong; there are innocent people serving time for crimes they did not commit. I have met a few. What I am saying is that the image that most of you have of Mr. Beach is illusory at best. Spend some time as a cop, a correctional officer, or a district attorney. Listen to the thousands of lies and incredible fantasies that many of these inmates conjur up. They tell these stories looking at you dead in the eye. No looking "down and to the left," no excessive blinking, none of the "tell-tale" mannerisms that allegedly indicate deception. Master manipulators that have rehearsed their stories for over twenty years have no such tells. Then listen to the classified tapes made of these inmates talking to fellow cons and their other associates and how they laugh and mock the gullability of so many committing incredible resources to "set them free" and you might not be so quick to judge a book by a glimpse of its cover.

Obviously YOU have not read the story and checked ALL the evidence to it's entirety! Wake up Mr. Dardo.... do some research and then make a comment. You have no idea what you are talking about.... unless of course your rediculous comments are because you are a reletive of one of the girls that was involved in Kim Nees's murder. You don't know Barry Beach, you know some of the people that were down at the river the night Kim was brutally killed. Wait until the evidence that has never been able to be shown to the courts and some people that were actually there and saw what happened come forward as they have been scared all these years. Then I'd like to see your quotes...eat your words!

It seems rather odd that the prosecuter for the original murder case was none other than Marc Racicot. This was Racicot's first murder trial and later he became Governor of Montana. It would be a huge blow to Racicot if this conviction got overturned and I fully believe that he has everything to do with Barry Beach still being in prison. Racicot, being former President Bush's close friend, has a lot of connections. It is not unreasonable to think that he would still hold some power within the Montana State legal system. I don't think that anyone will ever be able to prove any of it, but Mr. Racicot knows the tuth and it will eventually eat at him.

Ok say Barry Beach is manipulative or a liar or even a bad person, which I do not believe him to be, but if he were, would this make him a murderer??I have told a lie or two in my day and possibly even manipulated someone but never have I committed, attempted or even considered murder! He was a kid at that time and was scared and confused and tricked into confessing.They had no eye witnesses to put Barry at the scene, nobody saw him with her or even near her or even anywhere that night because he was at home just as he originally said he was until tricked into saying otherwise. Also there have been several people that have made statements that say Barry had nothing to do with it!They all name the same women over and over again.These women lured Kim Nees down to the river to beat her up and they got carried away and ended up beating her to death.Then they got VERY lucky when the police and attorneys bacame fixated on pinning this murder on Barry Beach! A few of the women have confessed to friends and family members, not to mention the bystanders that were there watching this poor girl being beaten to death.Of course they are too afraid to come forward which as far as I am concerned should result in them being charged as accessories to murder for never admitting to what they saw. They are just as guilty as the actual women who beat her, if they had any remorse or sympathy for Kim's poor family, they would stop being cowards and come forward! So in short Dardo, I have no doubt that you are very close to this case and problably very close with those who actually committed this terrible crime! Lets forget about Barry Beach for a min and concentrate on what is truly important which should be getting Kim Nee's the justice she deserves. If Barry Beach is denied a retrial again I will be absoloutley convinced that there are corrupt parties involved that are trying to keep certain evidence from coming to light. If Barry Beach truly is guilty then what is the harm in a retrial?? I believe we all know the answer to that, if Barry is re-tried he will be found innocent!

I agree! This man is innocent! justice has to be served...the police brain washed him when you can only be questioned for so long, they were only trying to put the blame on someone..i am going to law school and at the end of the day justice will be served!

Im curious to why he signed the 6 page confession if that was me they would have to torture me and I still wouldnt sign it not if im innocent. I'm from that area I hear all kinds of rumors. I watched the dateline special my opinion is your asking all the wrong people.

What they did to him WAS torture, he confessed to other killings as well in louisiana that they know proof positive he had nothing to do with-you spend all night under interrogation by a redneck sheriff when you're a scared kid, then run your mouth. Mr Beach should be set free, now.

.....also, you cant pick and choose portions of a confession that suit your wishes, when they knew Beach's admissions about the Louisiana killings were false that meant his confession was tainted, coerced, worthless. Still they carried forward, this case shouldn't have even made it to the courtroom, let alone into a 100 year sentence without parole, someone just wanted this whole thing to go away.
