Portland denies permit for Hempstalk at request of evangelical DEA agent
Plans for the third-annual Portland Hempstalk, a festival celebrating and calling for the legalization of marijuana, went up in smoke Wednesday as the Portland City Council refused to grant a permit. via Oregonlive.com

It just goes to show you that no matter how many times Mayor Potter and city council members tell us they REALLY are Democratic Party members, they are actually Republicans who run as Demo's because they know a Republican couldn't get elected to office here.

Yeah, either that, or they are really Democrats and just understand that smoking pot is still illegal (without a card) and that to give a permit were you know the participants are going to intenionally, openly and actively violate the law is not within their power as city counselors. Hmm, maybe that is more accurate than Egodragonis's idea.

OregonActivist, the law clearly says that you cannot punish or stop someone from lawfully assembling just because you imagine they will break the law.
For the record, John, I am not even a marijuana smoker. I just believe in the right to peacefully assemble. |

John, key point to your quasi legal definition is "lawfully" assembling. A board or counsel can refuse to issue a permit based on reasonable grounds justified by important government interest (preventing lawbreaking) that do not violate free speech rights. I read that article a long time ago, but I seem to remember the promoters openly advertising that pot was allowed. That seems like enough to trigger the board to protect the important government interest by denying the permit. |
