Mercer-Fraser settles for $1.3 million in fraud lawsuit

It is sad to see a strong community supporter and quality Humboldt employer extorted in this way.

I have filled out these online applications and can certainly understand Mr. Zabel's explanation of the events. If I were filling out that application on their behalf, I would have selected the same classification. In filling out these applications, they request that you select the classification that most appropriately defines your company. "Construction, Sand and Gravel" certainly seems appropriate to me.

Extortion? Strong community supporter? The system is designed to allow those who can pay, completely off the hook, now, no one can know the actual extent of the alleged fraud...And a corrupt system is free to continue... They should, at least, pay back all the benefits wrongly received and give the whistle blower a medal.

Funding every republican, good-ol' boy candidate for decades and building a playgroud here and there, isn't exactly "community supporter" material when you compare that to their "growth-as-usual" politicos who have placed every child at risk in neighborhoods inundated with raw sewage, record pedestrian and cyclist fatalities, and property crime, by rezoning and streamlining for additional development and subdivisions that claim to be paying their "fair-share" of infrastructure. NOT!

Sales of $27 million per year is a small business?

Just another reason why construction cost are so high in California. You have to bid in any possible law suits into your estimate. Californians have ever increasinly become law suit happy, guess its kind of like a rich mans welfare check!!!!!! Thanks to Mercer Frasier for all the donations they have made to this county. Maybe Justin could post here what they gave to charity in 2008 alone, I bet its well past the 1.3 million mark. Its Small Business like them that make this county go round.

a local company settles for less than .05 cents on the dollar probably what it would cost to fight it looks like they took the easy and smart way out and the feds saved a little face thank you mercer fraser you are a great community supporter.Fair auction,youth sports etc,

I know Mercer Fraser helped a local family after a tragedy with some transportation issues, but of course that does not get published. Shame on the feds. Keep up the good work MFCO.

yeah and thanks for challenging Measure T--NOT! So glad this cheater company can contribute to local elections now that they aren't even locally owned as they claimed in the press on the Measure T challenge. Maybe they can buy themselves some cheating politicians now.

Far away but more than a little interested.

It seems that businesses who have approved applications, etc. with our illustrious government bureaucrats are responsible to see that those same folks have not erred since the government is so large it cannot possible be held responsible for the performance its employees. What?????

Stay the course Justin and Mercer Fraser, sense may prevail, unlikely, but worth a wish or two.

I am not completely unbiased with respect to Justin. He and my grandson are closely related.

A statement on the Web site of Mann's attorney Paul D. Scott reads,“We specialize in helping whistleblower collect rewards for reporting fraud against the government in qui tam actions under the False Claims Act.”

This is whats wrong with The USA. Lawyers. Extortion. Same thing.

the whole point is that they misrepresented themselves as a small business when they are not and received special status that allowed them to win bids with this status against other companies that actually meet them. By whatever means this happened, they pulled profit away from whomever was 2nd in line on the bids they won due to this, which is fraud. Look for companies that were the bidder below them on these projects to be next in line for their lost wages.

This is another point that the process on these projects and special status contractors, etc. is a joke. Whether you blame CalTrans, the unions, or whomever, simplify the whole process by allowing everyone to bid on equal ground, no prevailing wage, no 10% allotment,etc. and give the taxpayers the best bang for our buck when awarding these jobs.

Some companies know the value of public support and contribute to local causes to obtain that support and good public relations. Small price to pay for the support they get while defrauding the same people to obtain an advantage in obtaining millions of dollars in contracts. No one ever said the management of Mercer-Fraser was stupid!
