As are our Vehicle Code laws upon the roadways of California by those who drive with or without a valid driver's license!

"The [red] light is supposed to be lit when a boater is returning to harbor"
This is plain misinformation. It has nothing to do with returning to harbor. Nav lights (red, green and white) must be lit at all times between sundown and sunrise when the vessel is in motion and a white anchor light must be lit between sundown and sunrise if the vessel is at anchor.
Perhaps the quoted line is a mis-interpretation of the memory aid phrase "Red, right, returning" meaning that if you can see both red and green nav lights on a vessel and the red is on the right of the green, the other vessel is approaching you.

Wow, what a great excuse to build another huge bureaucracy around.
Or, we could just attach a letter with boating safety tips and rules with every boat registration renewal.
