They are not Grafitti "Artists"- they are grafitti Vandals.

If his mother was so "protective"- how could she let him perform an obviously dangerous and illegal act? Everyone knew what he did.

If the kid wasn't a vandal he would still be alive

Susan McGowan is a liar. The passengers on the 5:17 train were helped onto a rescue train, but were told we were being taken to Woodside (westbound) and would then proceed east. We were taken to Penn, without any announcements from the crew. We were told that our train was now out of service, go to the platform and find another one. That's not being transferred, that's being treated like crap by an all powerful entity who thinks they can do whatever they want.

So graffiti is an acceptable “passion” for a child to have? Plain and simple, he was doing something illegal and got killed. If he wasn’t breaking the law, he would be alive today.

The tone of this story is all wrong. Why is the writer glorifying the boy, who was vandalizing people's property when he was killed? The boy wasn't being an artist or painting. He was scarring the city with ugly muck. If I had written this story, it would have begun: "A 13-year-old vandal who spray-painting graffiti near railroad tracks was hit by a train and killed."

I'm glad to see we're all in agreement: The boy was a vandal, not a bright artist. If he'd been home painting in his bedroom, like a real artist, he'd still be alive. Instead, he was out spray-painting other people's property, and now he's dead. There's a lesson to be learned there.

Why the hell would a 13 year old boy want to tag graffiti at a signal box? He was just playing with his life with the trains and lost. What a dumb a**. If he had common sense, he would still be alive. If the news media had even more secse, they wouldn't call his graffiti a work of art because of its location.

If the kid was smart enough, he would have known that what he was doing was illegal, and known better than to be on the tracks. Yes, the city needs to fix the holes but come on the kid needs to take responsibility also.

majority has no rights wrote:
Mike, of course they will sue. On the grounds that their son's artistic endeavors on the train tracks were denied because a train, for some reason, was on the tracks at the same time, thereby denying him of his civil rights and his first ammendment rights. How dare the train be on the tracks. Or maybe it will be a hate crime because, I am sure there were some white Christians on that train. Some ambulance chasing lawyer will think of something to bring about another frivolous lawsuit.
i was on the train that was inconvenienced for 4 hours. I won't sue but I won't grieve either.

If this story "don't sound Kosher," perhaps you should have tried standing in Penn Station last night waiting for the mob scene to clear out, with no (possibly very little) police presence.
This is the scenario my husband related to me when I picked him up 1/2 hour after his scheduled arrival at our LIRR station. How did he get home that early? He took the E Train to Jamaica. Had a railroad cop been there to suggest the subways to regular commuters, things wouldn't have been half as bad, but the people there were rude, obnoxious and pushing and shoving. Had cooler heads prevailed and a little bit of crisis management been in place, this woman would not have been told to go back on the train to go west. At least, not all the way back to Penn Station.
It wasn't an "un-Kosher" story.

He certainly should have learned that trains run on tracks and defacing other people's property and trespassing are wrong.

Of course they will sue, because these days no one takes responsibility for their own actions - it always has to be "someone else's fault." If you get killed doing something ILLEGAL, no matter what your age, there is no one to blame but yourself. But why should we be surprised. We're living in a society where the courts are filled with frivolous lawsuits that cost us all. Remember the people who tried to sue Mc Donalds for making them fat? And the burglar who sued the homeowners because he got hurt while robbing their house?
