When " WE" goes wrong
South Carolina's longest-serving sheriff has been indicted on bribery charges, according to federal prosecutors, making him the eighth sheriff in the state to face criminal charges or investigations in the past four years.
U.S. Attorney Bill Nettles said Tuesday that the 68-year-old Lexington County Sheriff James Metts faces 10 charges of taking bribes. He is also charged with wire fraud and conspiracy.
Court documents say Metts allowed friends to buy favors, accepting cash in return for agreeing to assist people who were in the country illegally and who were being detained. The indictment detailed several phone calls between Metts and a former Lexington Town councilman, who was acting as a go-between for the owner of several Mexican restaurants. Metts accepted an envelope full of cash in exchange for keeping some of the restaurants' employees from ending up in federal databases of immigrants who weren't supposed to be in the U.S.
In office since 1972, the Republican has received a number of awards, including the Order of the Palmetto and the Order of the Silver Crescent, and is up for re-election in 2016. It wasn't immediately known whether he was in custody.
His lawyer, Sherri Lydon, issued a statement on his behalf. "Sheriff Metts has dedicated his life to law enforcement and serving the citizens of Lexington County. He denies the allegations and looks forward to his day in court," she wrote.
Gov. Nikki Haley suspended Metts about an hour after the indictments were released and appointed Lewis McCarty, who retired in 1999 after nearly 30 years with the Lexington Department, as the acting sheriff.

Former WCBS news anchor Rob Morrison was arrested this week after his wife Ashley went to the police over his incessant calling. The Daily News shared the details surrounding the case on Wednesday. Though Morrison maintains he did nothing wrong, it seems the authorities do not necessarily agree.
Many may remember that Rob Morrison was arrested in 2013 after an incident where he allegedly choked and threatened his wife Ashley. The two have reconciled since then, but it seems things are not going entirely smoothly. The incident in question occurred after the two started arguing about possibly relocating.
Morrison stated after the arrest, via the Connecticut Post, that Ashley had initiated the discussion about the relocation. He says he tried to put her off because their son was nearby. Rob says she became aggressive, and when their son Jack was seen crying as he overheard the fight, Ashley made Rob leave the house. The protective order that was in place allowed Rob to visit the house, but he was not to harass his wife.
After he left, Rob says Ashley cut off communication and he “became concerned.” Morrison says he just wanted to know that Jack was all right, and over the course of the next couple of days he “tried like h*ll to get in touch” with Ashley. He adds that the couple reconciled by the end of the weekend. However, in the meantime, Ashley went to the police.
Ashley Morrison went to the police after her husband had tried calling her 121 times, reports indicate. She was said to be physically shaking and scared when she went to the police on the Sunday of Memorial Day weekend. According to Darien Police Sgt. Keri Isaac, she also indicated that she believed Rob “could kill her if she has him arrested.” She also said that her husband said she would never get rid of him.
Later it seems Ashley had a change of heart and felt “irate” over the warrant issued for Rob Morrison's arrest. She seemingly did not want to pursue charges, but the former CBS anchor is facing charges of second-degree harassment and violating a protective order. His next court hearing is slated for July 15.

The prime suspect in the Boston Marathon attacks has asked a US court to move his trial to Washington, DC claiming he will not be tried fairly in the northeastern city.
The April 15, 2013 attacks, which killed three people and injured 264 others, were allegedly planned and carried out by ethnic Chechen brothers Tamerlan and Dzhokhar Tsarnaev.
Tamerlan was shot dead by police on April 19, 2013, after killing an officer.
Dzhokhar is due to stand trial in Boston in November, accused of 30 federal charges and could face the death penalty if convicted.
But in a 10-page court document filed late Wednesday, his lawyers asked that his trial be moved to Washington DC to assure him the fairest possible trial.
A survey revealed “an overwhelming presumption of guilt” in Boston,“prejudgment as to the penalty that should be imposed” and “an extraordinarily high number” of potential jurors who attended the 2013 marathon or who know someone who did, it said.
“Our preliminary review of the information collected leads us to conclude that prejudice must be presumed in the District of Massachusetts,” the document said.
“Accordingly, we seek a change of venue.”
The lawyers presented findings from surveys in Boston, the western district of Massachusetts, Manhattan and Washington DC, presenting the federal capital as the “least prejudicial.”
They pointed out that publicity, local impact and “galvanizing community reaction” changed the venue in the trial of the Oklahoma City bombing, arguing that in this case the community impact was even greater.
Last month, lawyers for Tsarnaev also asked that capital punishment be ruled out for their client — a request prosecutors opposed in a separate document.

When "WE" goes Racist
After a nearly four-month investigation, police in Dayton, Ohio have concluded that a white bus driver’s story – that he was shot in the chest by three black youths and that his life was saved because a slender religious tract in his shirt pocket stopped the bullets – was not a miracle but a lie.
“The whole thing was a hoax based on ugly racial stereotypes,” Mark Donaghy, executive director of the Greater Dayton Regional Transit Authority (RTA) told Hatewatch yesterday.“I don’t know if there’s anything that could make me more angry.”
Before police revealed the truth this week at a news conference and officially closed the case as “unfounded,” the story of Rickey Wagoner’s adventure in the pre-dawn darkness of Feb. 24 had flashed around the world.
The story had everything: crime, race, a middle-aged, out-of-shape working stiff turned superhero and the word of God literally saving a man’s life.
But Dayton’s director and chief of police, Richard Biehl, told Hatewatch “the high probability and likelihood is that this was a staged event.”
“We don’t believe, certainly,” Biehl said,“based on our ballistics testing, there’s any way possible he could have been shot in the chest in this book and those bullets not go well through that book and into his torso.”
Wagoner told reporters he had no comment when they knocked on his door after the chief’s news conference.
As for a possible motive, the chief said he could only speculate since Wagoner had stopped talking to investigators early on in the case. Biehl said Wagoner owed more than $100,000 in back taxes on about a dozen pieces of property.
The union contract for RTA employees includes a felonious assault insurance policy for $100,000.“But the reality of the coverage is,” Donaghy said,“that a person pretty much has to die for their family to receive that kind of money.”
Crying Wolf: The Black Guy Did It
The chief said Wagoner refused to take a polygraph test but his “story remains unchanged.” That story is now just another sad example of the modern day version of crying wolf: the black guy did it.
Wagoner, 49, joins the likes of Charles Stuart, a white man in Massachusetts who killed his wife and blamed it on an imaginary African American man, and Susan Smith, a white South Carolina woman who wanted to start over with a new man, but not with her old kids, so she drowned her two small children in a lake, and said a black man had carjacked her with the children in the back seat, and Ashley Todd, a white Republican volunteer for John McCain’s 2008 presidential campaign who carved a backwards “B” in her forehead and blamed it on a black Barack Obama supporter (she used a mirror when carving the “B” and didn’t realize it would be backwards).

When "WE" Expires
In 1951, the sentinel who guarded the Third Reich’s most notorious death camp arrived in the United States, amiable and voice thick with a central European accent.
After breezing through immigration, he settled into a small rowhouse near Pennypack Park in Philadelphia, where neighbors knew him as “Hans.” He found work as a tool and die maker at a local engineering company in nearby Fort Washington, where he would work for 32 years. He raised three children, retired at 66 and settled into a drama-free existence that, he says, didn’t even involve one traffic ticket.
Whatever he is — killer or hapless fool who barely knew a thing, as he claims — Johann Breyer clearly succeeded in putting a great deal of time and space between himself and the events of 1944.
Now, across time and space, the past has come back for him.
Breyer, 89, hobbled into a Philadelphia courtroom on Wednesday in a purple inmate uniform, stooped and with a cane. Charged with 158 counts of “complicity in the commission of murder,” prosecutors have accused him of the “systematic murder of hundreds of thousands of European Jews, transported between May 1944 and October 1944 in 158 trainloads to Auschwitz,” according to federal court documents filed in Philadelphia.“Approximately 216,000 Jewish men, women and children from Hungary, Germany and Czechoslovakia [were] transported by these trains.”
Breyer was arrested on Tuesday, one year after a German court charged him and asked for his extradition. If successful, Breyer, one of the last living members of the SS “Death’s Head” Nazi battalion, will be the oldest person ever extradited from the United States to face allegations of Nazi crimes.
Breyer denies culpability. He claims he was ignorant of the executions at Auschwitz, where more than 1 million Jews were killed.“Not the slightest idea, never, never, ever,” Breyer told the Philadelphia Inquirer in 1992.“All I know is from the television. What was happening at the camps, it never came up at that time.”
He added in a 2012 interview with the Associated Press:“I didn’t kill anybody. I didn’t rape anybody… I didn’t do anything wrong.”
Prosecutors say that doesn’t matter. His mere presence at Auschwitz is enough to merit extradition.“He is charged with aiding and abetting those deaths,” Assistant U.S. Attorney Andrea Foulkes told the Inquirer.“Proof doesn’t require him to have personally pulled any levers. His guarding made it possible for those killings to happen.”

THE BRONX - A Bronx tax preparer suspected of scamming clients and the government out of $2.5 million has pleaded guilty to charges related to filing fraudulent tax returns.
News 12 first reported on the crooked practices of Mark Goldberg when he was arrested last year.
The Manhattan U.S. Attorney's Office says it uncovered a seven-year tax crime that includes Goldberg claiming $7 million in fraudulent credits and deductions for himself and his clients.
Out of 46 different counts, Goldberg made a guilty plea to one count of subscribing to a false and fraudulent tax return for himself, one count of aiding and assisting in the preparation of a false tax return for a relative and one count of wire fraud.
He faces up to 26 years in prison, and is set to be sentenced on Dec. 1

State Senator Thomas W. Libous is a natural in Albany’s clubby corridors, a world away from the family grocery store in Binghamton, N.Y., where he worked growing up.
A Republican with a nose for deal-making, he ascended to become one of the most powerful lawmakers in the capital and forged a close bond with a fellow political tactician, Gov. Andrew M. Cuomo, despite their partisan differences.
But for several years, the life and career of Mr. Libous (pronounced LIB-us) faced grave threats. In 2009, he was found to have prostate cancer, which later spread to his lungs. And law enforcement officials were examining whether he had misused his office in an effort to obtain a job for his son.
On Tuesday, Mr. Libous’s future grew even more troubled. He was indicted along with his son Matthew on charges that the senator had lied to federal agents and that his son had filed false tax returns. The senator and his son were charged in separate indictments.
The outcome of Senator Libous’s case, in which he faces up to five years in prison, could further imperil efforts by Republicans to cling to power in the Senate, their last stronghold in New York politics.
Mr. Libous, 61, of Binghamton, is a fixture in the Senate, where he first won his seat in 1988.

WE The People or WE The Corporations?
In civics class, we still teach our children that American-style representative democracy is a model for the world to imitate. But in practice, our government has become a broken system of corrupt lawmakers and crony capitalism. It's time to either change the lesson plan or fix the government.
Wealthy special interests use lobbying and campaign contributions to buy access and influence in the halls of Congress and they use that access to advance their own self-interest.
For example, in 2003 when Congress passed Medicare Part D to provide prescription drugs to seniors, pharmaceutical companies spent over $100 million to ensure the final bill barred the government from negotiating prices with the drug companies. As a result, taxpayers foot the bill for bloated medical costs while drug companies rake in billion dollar profits. Meanwhile, the congressman who sponsored the bill, Rep. Billy Tauzin left Congress for a seven-figure salary with the largest pharmaceutical lobbying firm. The story is the same for defense spending, the financial industry, big agriculture and big energy. Companies invest billions of dollars in lobbying and campaign contributions in order to secure even bigger profits.
The root of our current crisis extends back to the 1970s. In 1971, future Supreme Court Justice Lewis Powell issued a memo in response to several environmental and consumer protection laws encouraging corporations to organize in order to protect their interests. He writes: "Business must learn the lesson ... that political power is necessary; that such power must be assiduously cultivated; and that when necessary, it must be used aggressively and with determination."
In the aftermath of Powell's memo, the number of firms with registered lobbyists in Washington ballooned from 175 to nearly 2,500 a decade later, and trade organizations like the Chamber of Commerce doubled in membership.
After Powell was named to the Supreme Court, he wrote the Buckley v. Valeo decision that equated money with free speech and paved the way for the democracy demolishing 5-4 ruling in Citizens United v. Federal Election Commission, which concluded that if corporations are people and money is free speech, then corporations should be allowed to spend an unlimited amount of money in order to influence elections.
While the candidate with the most amount of money does not always win, that's not the issue. Many corporate political action committees make significant contributions to both political parties. The unfettered role of money in politics doesn't give one party an advantage over the other; it ensures that big donors dominate the national conversation and maintain unprecedented access to lawmakers. As a result, we get laws that heavily reflect corporate interests not public interests.
There is only one way to restore our government of, for and by the people. We need to amend the Constitution to say: 1) Corporations are not people; 2) Money is not free speech.

Two days after losing in Mississippi’s US Senate Republican primary runoff election, State Senator Chris McDaniel is still refusing to concede to the winner, incumbent Senator Thad Cochran. McDaniel and his supporters (like Sarah Palin) claim that the election results are illegal due to Democratic voters crossing over to vote in the Republican primary runoff. They point to Mississippi election law, which states that voters who participate in a primary election should intend to support the candidate they vote for in the general election. Also, voters who participated in the Democratic primary are barred from voting in another party’s runoff election.
While appearing on the Mark Levin Show Wednesday night, McDaniel said that Cochran received 35,000 Democratic votes on Tuesday. Apparently, he is counting all of the extra votes Cochran got compared to the primary election. Of course, McDaniel conveniently ignores the extra votes he got himself. He also stated as fact that a number of these voters participated in the Democratic primary, so their votes should be cast aside. On top of that, McDaniel feels that a lot of these voters will not support Cochran in the general election this coming November, so more votes should be cast aside.

A Silicon Valley success story turned sordid this week with the arrest of an upscale prostitute who allegedly left a Google executive dying on his yacht after shooting him up with a deadly hit of heroin.
Forrest Hayes, 51, was found dead by the captain of his 50-foot yacht Escape last November. At the time, a simple obituary described him as a beloved husband and father of five who enjoyed spending time with his family and on his boat.
On Wednesday, that got a lot more complicated as Alix Tichelman, 26, of Folsom, stood handcuffed and mumbling in red jail scrubs facing manslaughter charges for her role in Hayes' death, as well as drug and prostitution charges. She is being held on $1.5 million bail.
Surveillance footage from the yacht shows everything, police said, from when she came aboard until after Hayes collapsed. That's when Tichelman picked up her clothes, the heroin and needles, casually stepping over Hayes as he lay dying. She swallowed the last of a glass of wine, lowered a blind and walked back on the dock to shore, police said.
Santa Cruz Deputy Police Chief Steve Clark told the Associated Press on Wednesday that Hayes had hired Tichelman before, and that their Nov. 23 encounter "was a mutually consensual encounter including the introduction of the heroin."
Clark said it appears this might not have been the first time she left someone in trouble without calling 911 or trying to help. Without elaborating, he said his agency is cooperating with police in a different state on a similar case.
"There's a pattern of behavior here where she doesn't seek help when someone is in trouble," he said.
News vans gathered outside Hayes hilltop estate overlooking the glittering Monterey Bay on Tuesday. The five-bedroom home is on the market for $4.2 million. The yacht has been sailed out of the harbor to the Bay Area. Hayes' widow has not spoken publicly and a blog created in his memory was deleted Tuesday. On the website, friends and co-workers were seemingly unaware of how he died. They fondly described their time together, Christmas parties on his boat, engineering teams at Sun Microsystems, traveling to China for Apple and most recently at Google, where they said he was involved in the Glass eyewear projects.
