In Cookeville, Tennessee, Daryl Hill wants to know how the Sparta, Tennessee Wal-Mart sold the MP3 player as new, which violates Wal-Mart's policy: returned items are not supposed to be put back on the sales floor.

It's horrible that a child had to be exposed to this, I say hit Walmart where it hurts!! They are out to turn a profit, no matter who they have to step on...DO NOT SETTLE OUT OF COURT!!! Bury them!

I don't know about that. Really, Walmart might not have had any responsibility for this: someone might have returned it to the store with this stuff on the video MP3 player, and Walmart didn't do a 'clear' of the memory, which isn't standard procedure for most returns of electronics when they allow them to be returned.

Or, it could have come from the manufacturer with the porn on it, thereby letting Wal-Mart off the hook again because they could not have prevented this.

Really, the first thing I get with ANYTHING that has a hard drive or flash memory in it: do a 7-level overwrite pass on it to make sure that EVERYTHING is gone off it but what I put on it!

Certainly did'nt take them long to get an ambulance chaser involved. Suing WalMart won't help, they'll just pass the liability onto their customers with higher prices. Take a new MP3 player and call it good. No wonder society is going down the drain.

I've seen plastic bags of men's underwear sold at Wal-Mart with bag scotchtaped shut. I accidently bought one bag, to find a pair of underwear missing from it.(My hometown 5&10 sold toothbrushes for 50 cents each; they had been opened and scotchtaped shut!)

Walmarts policy is supposably not to sell returned merchandise. From personal experience, they do it everyday. My husband was fired because he would not sell the returns.

company policy to not put returned merchandise back on the floor??? yah!! i've seen stuff i returned back on the shelf before i got out of the store!

WalMart's profit margin's are so small, with all that union labor and non-competitive policy against smaller neighborhood stores, they have to re-sell returns. She's lucky they didn't charge her more for it being pre-loaded. Ingrate. I mean the Walton's are barely still in the top ten of American Billionaires. How do we expect them to keep themselves in Yacht's if they have to eat returns. Geesh!

Wal-Mart does put all returns back on the shelfs. I know cause they had already told me about what they did, so i return one item back and i made a mark on it, well to my surprize, the next day i went back and got the same thing and guess what the box was taped and when i open it and check for that mark it was there,,return it and call WalMart main office, but they just said they where sorry, so be careful when you buy something,,i make sure now that the box or anything i am getting is not tape or has been open cause you can tell..They should do something about all returns..

Got news for you... Wal-Mart does NOT employ union labor. They are well known for being anti-union.

wal-mart puts return items back on the shelf all the time,i have watched them do so if its returnd with the package yes it gose straight to the shelf used or even broken in this case a lawsuit should be filed against this store,for neglagents

I can agree Wal-mart does not only sell returned stuff, they don't check it either. I bought an Emerson dvd recorder only to come home and find a kid's first communion video in the vcr and a blank dvd in the dvd recorder. So I guess this is common practice.

Of course not one person has entertained the possibility that the father or mother downloaded the stuff before giving it to the child just so they can try to blame and sue WalMart. If WalMart if guilty of negligence then fine, but I smell something rotten.

That's because more often than not, people rip the bags open to make sure they are the right size. I am guilty of doing that myself, tsk tsk.

Just to be safe though, buy dark colored underwear - hides the skidmarks MUCH better, lol.
